The EU Regulation 1215/2012, as well as the Polish civil procedural law regarding individual employment relationships are employee-interest oriented. The employee’s domicile is a specific form of privilege on the level of the national jurisdiction regulations establishing international competence of national courts. The domicile provides effective protection for the employee in case of a potential dispute with an employer, who initiates the proceedings. Unfortunately, neither the Regulation 1215/2012 nor the Polish civil procedural law provides for equivalent protection for a third state employee (an employee from outside the EU) compared to an employee domiciled in Poland. The paper argues that despite a one-sided regulation, suing a third state employee before a Polish court is in principle impermissible. When applying the objective criterion to determine whether there is a national jurisdiction to hear the case, the court should consider the need to protect the employee and his or her legitimate interests. The author posits that the employee’s interest constitutes a legal basis for assessing whether in the proceedings before a Polish court - as forum conveniens - it is possible to safeguard the rights of a weaker party of a particular legal relationship. If a choice of court agreement was concluded, suing a third state employee before a Polish court will not be possible. This is because the prorogation agreement is subject to Article 23 of the Regulation 1215/2012. This provision requires that for the prorogation of jurisdiction to be effective, the employee, as party to an agreement, must be domiciled in one of the Member States.

The aim of the article is to compare the way in which the issue of responsibility for violations related to the acts of unrecognized authorities claiming to be States is treated by the European Court of Human Rights and other international courts, particularly the International Court of Justice and the International Criminal Tribunal for the former Yugoslavia. The article considers in detail the relations between jurisdiction and responsibility, responsibility of parent States (including the concept of “positive obligations”) and responsibility of States which provide assistance to unrecognized regimes (with emphasis put on the concept of “effective control”). The results of the study indicate that the jurisprudence of the European Court differs in several important aspects from decisions of other international courts. These differences, while undoubtedly enhancing the protection of human rights in Europe, contribute to the process of fragmentation of the law of international responsibility.

The problem of renvoi is a problem of coordination of legal systems. Such coordination is not necessary any more as legal systems are subject to growing unification in unified private international law. If in this system of unification, however, the law of third states is governing, renvoi may be necessary as soon as international harmony of decisions and basic principles of the law of conflict of laws are not violated. As the European Union is about to get a unified code of private international law, renvoi will only be applied in cases governed by the law of third states.

Problém zpětného odkazu (renvoi) je problémem koordinace právních systémů. Taková koordinace není nutná, jakmile je kolizní právo sjednoceno. K tomuto stavu postupně spěje Evropská unie, jež hodlá unifikovat i obecnou část mezinárodního práva soukromého. Potom bude zpětný odkaz potřebný jen v případě, že rozhodným kolizním právem bude právo třetího státu.

The purpose of this contribution is an analysis of lis pendence in the Regulation No. 1215/2012 on jurisdiction and the recognition and enforcement of judgements in civil and commercial matters (recast) and based on it an assessment of conditions of possible opening this regulation towards third states. The opening of the Brussels system requires a reflection of risks associated with its implementation. The main purpose of this regime is to prevent of irreconsilable judgements rended by two courts in different states in the same matter. The operation of lis pendence dependens upon four assumptions. The first assumption concerning the design of the regulations response to parallel proceedings is that the appropriate forum may be sufficiently identified. The second assumption is that there are no relevant differences between the courts of Member States in terms of the legal and practical implications of litigation. The third assumption is that parallel proceedings and irreconcilable judgements in the same matter are a real threat to the stability of the regulation and in particularly to the mutual recognition and enforcement of judgements between Members States. The forth assumption is that he model of litigation embodied in the Brussels regime adequately secures procedural justice.
