Otázka právního státu u Michela Foucaulta

This article analyses a theme which is at first sight is only indirectly present in Foucault’s work the question of the legal state. The author analyses a wide variety of Foucault’s texts, giving special attention to the first volume of the History of Sexuality and to the seminars on the genesis of bio-politics and on the origin of territory. He reaches the conclusion, on the basis of rather indirect indications, that in Foucault’s thought the question of the legal state is treated negatively as a concept that has no place in the analysis of the modern conception of power which Foucault is endeavouring to provide. Support for this attitude on the part of Foucault is given by a wide range of examples, ranging from the medieval conception of power to an analysis of modern ordoliberalism.

Problem hybrydy

In the present paper I discuss the problem of a hybrid as a concept, which started functioning on the borderlines between various discourses – in particular legal, media and post-colonial studies. Hence the term itself was appropriated as a textual concept – from the borderline with philosophy – by the institutional discourse that Michel Foucault would include into the sphere of bio-politics. Here I can see the danger of transferring the textual creation into the domain of biological sciences (hence the term that was transplanted from biology returns to it, changing its status from a fictitious one into the real one), and what follows – a hybrid becomes a problem of civilization and societies within which various institutions of bio-politics operate.

There are places which create their own rituals and circumstances give them functions. The kindergarten seems to be such a place - "a different space". The object of my considerations, in which I applied the understanding of the specific kindergarten space as a “no-place in the place”, are the six principles defining Foucault's heterotopy. Considering each of them, I refer to preschool as an institution which, apart from implementing its basic goals focused on care and supporting child’s development, becomes a unique microcosm for every pupil.

The article concerns dynamic aspects of scientific discourse understood as a domain of communication subject to cultural influences. The problem, inspired by Michel Foucault’s concept of archaeology of scientific reason, is presented through the ex- ample of alchemy, a specific phenomenon co-creating a scientific discourse both in the past and in the present. The relation of science with its discursive aspect (in various ways) with the past, and thus also with memory is undeniable, no matter how you consider the issue. This relation also affects the perception of science as such and scientific discourses, which is still an interesting field of observation. The discourse(s) on alchemy and its very status in the universe of communication confirm the dynamics of science and the discourses belonging to or co-constituting it, but in no way do they confirm the thesis of the teleological (in the sense of improving development) history of communication, including scientific communication.

Michel Foucault is considered one of the most influential thinkers of the late 20th century. His original research concepts, focusing primarily on the critique of contemporary social institutions, are often used in educational studies. They mainly concern the mechanisms of power present in schooling and upbringing. However, Polish pedagogical studies do not pay attention to the fact that Foucault’s research also included the history of schooling, upbringing, and pedagogical thoughts. This article shows the place of the history of education in Foucault’s scholarly workshop on the example of the book Discipline and Punish. The Birth of the Prison. Foucault’s references to the history of education and his source studies are analysed. Foreign historical-educational studies using Foucault’s concepts are also presented along with proposals for new areas of research with Polish historians of education in mind.

Postfoucauldian discourse analysis is a vigorously developing approach to discourse studies focusing on the analysis of power, discourse, knowledge and social practice. This comprises studies deriving from Michel Foucault’s thought, reinterpreting it, however, with the aim at application to an analysis of empirical data, also from the field of pedagogy and education. The purpose of this paper is to present main concepts and categories of postfoucauldian discourse analysis (e.g. enunciation, discursive formation, discursive practice, procedures for the control of discourse, dispositive, regime of truth) and guidelines for conducting research on the example of an analysis of chosen public texts concerning the debate on liquidation of middle schools in Poland as a result of the reform of education carried out by Law and Justice’ government.

This article discusses a number of texts written by Camilo in the early 1870s in response to the prosecution and conviction of his friend Vieira de Castro for the murder of his adulterous wife, and in the wake of the controversial book by Alexandre Dumas Fils, L’homme‑femme, of 1872, which sought to justify such actions. These texts demonstrate inconsistencies between a very modern, emancipatory stance adopted in the leaflet A Espada de Alexandre and the more patriarchal tone of Camilo’s fictional works written during the same period. This paper seeks to attribute these contradictions to an unresolved preoccupation on Camilo’s part with the authority traditionally assigned to the male in matters of sexuality and marital convention, even though a closer examination of the texts provides ample evidence for regarding these very same attitudes as outdated.

This paper is an analysis of the category of power in Michel Foucault’s philosophy. In the whole work of the philosopher it is definitely abused and often used as a hyperbole or a metaphor only, not as a specific social relation. I argue that especially in Foucault’s writings of 1970s the category of power is used not only as a hypothesis, but also as a justification, which makes much of Foucault’s interesting analysis only a postmodern narrative. In this respect philosophy of Foucault remains Hegelian, trying to enclose the rich experience of European modern culture in one mind, with one superior rule.

In this article the authors raise the question of how to understand the concept of counter-history. In addition, the authors deal with the relationship between counter-history and historiography. In the fi rst part of the text, Counter history and the construction of the community, Maria Solarska refers to the diff erence between the legal-philosophical discourse and the historicopolitical discourse, the diff erence worked out by Michel Foucault. Th e second part of the text, Historiography as a form of counter-history, Maciej Bugajewski refers to Walter Benjamin’s On the concept of history and analyzes the counter-history as a practice of change in real history.

The object of the present study is a particular literary reference that repeatedly appears in Michel Foucault’s work — a reference to the work of Ann Radcliffe. We present a close study of the passages where Foucault, in one way or another, deals with Ann Radcliffe’s novels (or novels that he believed to be written by Radcliffe), and attempt to show that Foucault’s interest in the “literature of terror” is not at all accidental. For Foucault, Gothic fiction is a literary “embodiment” of the historical transition from classicism to modernity.

Michel Foucault, in his famous 1971 lecture concerning Edward Manet’s paintings, focused on three problems: the space of the painting, the lighting and the position of the viewer. At the beginning of the 1890s, i.e. at the beginning of Olga Boznańska’s creative path, the connection between the paintings of the young Polish artist and the works of Manet had already been noticed. A clear concentration on problems which Foucault pointed out in Manet was observed in her paintings precisely at this time. This fascination with Manet faded in a later period; nonetheless the infl uence of the French artist was an important experience in Boznańska’s development of her unique and individual style. Boznańska’s paintings, created under the infl uence of Manet, represent a clear stage in the development of her own creativity.

Genealogy is a well-known philosophical method, often used by a disciplines of Friedrich Nietzsche and Michel Foucault. It is seen as part of a broader programme—one that offers critical tools for examining the modes of production of the modern polit-ical subject. The aim of this article is to show the usefulness of the genealogical method as a mode of critique separate from the philosophical programme it often belongs to. In order to do this, the paper examines the transformations of genealogy from Nietzsche to Foucault as well as the common lines of critique.

The subject of the article is the analysis of a specific feature of contemporary political and administrative power. As analytic categories the author uses Foucaultian concepts of power discourses: sovereignty: the type of individualized power which strives for self-conservation (pre-modern type of power) and governmentality – the type of non-individualized power the aims of which are control and management of the population (modern type of power). Contemporary power – the bureaucratic power described by M. Weber etc. – seems to be the type of governmentality. But in this field emerges a new type of sovereign power legitimized by the discourse of governmentality – management and protection of the population. Its examples are analysed by G. Agemben i J. Butler indefinite detention in Guantanamo. In this articles, the author focuses on symptoms of the new type of sovereignty in day-to day government action – the practice of the polish organ of compulsory social insurance – Social Insurance Institution (Zakład Ubezpieczeń Społecznych).

This voice is a reaction to Magdalena Archacka’s text, which is not so much the review of my book, but the defence of “the only correct” interpretation of Michel Foucault’s works. By the means of repeatings everal facts, which, in my opinion, are important, but unnoticed by the reviewer, the text presented hereby is an attempt to encourage the Reader to adopt different lines of receiving the French philosopher’s works, outside the dispute of who understands the Foucauldian gouvernementalité better.

The introduction to the volume Foucauldian Perspective in Contemporary Research consists of two parts. The aim of the first part is a brief presentation of the main directions in contemporary studies inspired by Michel Foucault’s legacy to which belong, for example, studies in biopolitics, governmentality studies, critical analysis of neoliberalism, dispositive analysis, and reflection on the categories of critique and parrhesia. The second part characterizes the thematic field of the volume, which reflects the multidimensionality and complexity of post-Foucauldian research.

The concept of power is one of the main problems of social concepts in the work of Michel Foucault. The philosopher critically analyzes contemporary political, religious and ideological discourses as well as the historical conditions of their emergence, in order to undertake the trouble of defining the concept of power. The term itself is understood by him extremely holistically – it covers all aspects of the individual, family and social life of an individual (entity), social discourse, the problem of knowledge, exclusion and ideological influence, including religion. The purpose of the article is to describe the elements of the identity of power in the thought of Michel Foucault and answer the question how it is constructed and how it affects the empowerment of man in society?

The article presents a legal-historical study on the birth of the modern system of public protection of the child with public authorities endowed with authoritative powers over children and their families in the name of child protection. It seeks to defend the proposition that the modern system of public protection of the child is far closer to the criminal policy of the State than to the protection of the human rights and freedoms of the child. It points out that the roots of this system are strongly linked to the state’s penal policy to combat poverty in its most pressing manifestations of begging and vagrancy, and as a result, the system still carries a significant disciplinary burden. The article is based on historical legislative, doctrinal, and journalistic sources. Its theoretical framework is given by the work of the French philosopher Michel Foucault, a leading critic of modernity, bringing such concepts as “disciplinary society”, “pastoral power”, or “illegalisms”. The article is divided into three thematic sections: the first dealing with socio-legal changes in the late 18th and throughout the 19th century, with an emphasis on their implications for the area of care for the poor; the second focusing on the penal regulation of poverty and its evolution during the 19th century; and the third presenting the legal mechanisms that made it possible to transpose both objectives and instruments of criminal policy into the private law. The article’s conclusion briefly outlines the starting points on which we should focus if we want to rid the system of public protection of the child of both its disciplinary nature and impact.

The aim of this paper is a critical reflection on Michel Foucault’s concept of dispositive and its application in social research. Dispositive means a heterogenic composition of discursive and non-discursive elements of social reality linked together with the dynamic relations of power. Since two decades in the frames of post-Foucauldian discourse analysis the attempts at operationalizing the category of dispositive have been made. As an analytical category dispositive refers to the mechanisms of socially dispersed power, which can be studied empirically on the basis of discursive and non-discursive data. A research perspective of dispositive analysis has emerged as a result of an interest in dispositive. This paper presents the main guidelines of this perspective, as well as a typology of applications of the Foucauldian category of dispositive in empirical research, illustrated with chosen examples of German and Polish scholars’ works. This presentation is accompanied by a consideration of inconsistencies and deficiencies of such methodological approach.

Michel Foucault is one of those authors who significantly impacted upon broadening the meaning of the term “power,” including realms in which one is to look for its symptoms. Foucault’s contribution to the developmental tendency within the studies of power is especially striking. In the History of Sexuality, Foucault was to openly claim that power was plainly everywhere. For years Foucault had been elaborating two ways of legitimizing this view, which is named here “a prevalence of power” thesis. For the sake of the below analysis, the first justification is going to be called historiosophical, and the second—social differentiation justification. The article aims at criticizing both of them and, although indirectly, the very thesis they support. Since the boundaries of all Foucauldian analytics of power are outlined by these two justifications, their reconstruction and critical consideration are of crucial importance for the post-Foucauldian current in social sciences.
