After the accession of several Central and Eastern European countries to the European Union in 2004, new challenges arose for their highest judicial institutions to define and shape the relationship between the national and European legal order. This paper assesses the first decade of the effort of the Slovak Constitutional Court (SCC) in interpreting the relationship between domestic and EU law via applying the concept of constitutional pluralism which presumes a specific relationship between the legal orders characterized by their heterarchical structure, mutual interaction and cooperation rather than of a hierarchical, monistic structure, governed by clash over dominance. Answering the research question how the SCC has positioned itself vis-à-vis the constitutional monism v. pluralism dilemma can offer an insight on the general relationship between domestic and EU law in Slovakia. By analysing statutory law, selected judgments and reviewing secondary literature, the paper argues that the SCC seems to have chosen the monistic, hierarchical approach to the relationship, having rejected constitutional pluralism. At the same time, this position is not articulated clearly enough due to the veil of secrecy that to some extent still prevails over the SCC’s doctrinal attitudes to EU law. The findings of the paper, which combines conceptual analysis of constitutional pluralism with review of relevant legal provisions and case law, demonstrate the need for a more active and straightforward approach of the SCC when dealing with the challenges of EU law.

This article presents the sources of ultra vires review. It follows the evolution of this doctrine by the example of some European Union’s Member States and compares their approach towards European integration. Some of the Member States’ arguments may lead to balancing various interests. Others indicate a will to choose only the preferred obligations.

The article analyses some theoretical ideas of European constitutional pluralism influenced by Ehrlich’s sociology of law. After the introductory analysis of the concept of EU constitutional pluralism and critique of its positivist understanding, the article focuses on theory of societal constitutionalism, normative plurality and heterarchies prevailing over the normative hierarchical concept of law. While more conventional legal theories frame these heterarchies and pluralism of transnational constitutionalism by monist approaches, theory of societal constitutionalism radicalises these heterarchies and considers the transnational system of law one of many societal systems of functionally differentiated global society. The importance of Erhlich’s sociology of law consists of its capacity to analyse this differentiated system of law which functions independently of state organisation with its monopoly of political power in both supranational EU law and transnational global law. The concluding part, therefore, focuses on Teubner’s theory of societal constitutionalism which draws on Ehrlich’s sociological notion of law in the most original way, analyses knowledge regimes as new constitutional subjects and understands them as a new constellation of relationships between social power and constitutional authority stretching beyond classic constructs of constitutional theory and cosmopolitan ethics as legitimation forces of global law and politics.

The aim of this paper aims is to reconstruct the original context, the characteristics and the main assumptions of M. Hauriou’s theory of the institution as one of the most coherent and comprehensive examples of legal institutionalism. By means of critical source analysis, the paper presents the basic elements of the notion of the institution together with its ontological and epistemological assumptions concerning both the very concept of law and legal methodology. The second part of the paper presents the critical approach expressed in Hauriou’s theory towards some core concepts of public and constitutional law by opposition to traditional, normativist and positivist approaches to constitutionalism. Hauriou’s work, despite its importance as indirect inspiration for contemporary doctrines of constitutional pluralism, is nowadays barely present in European legal science discourse. The last part of the paper is therefore dedicated to some closing remarks on current relevance of the theory of the institution with particular focus on the challenges of increasing pluralism of legal orders.

Celem niniejszego artykułu jest rekonstrukcja kontekstu powstania, dokonanie charakterystyki i wskazanie głównych założeń teorii instytucji M. Hauriou jako jednego z najbardziej wyczerpujących i spójnych przykładów instytucjonalizmu prawnego. Artykuł prezentuje, przy wykorzystaniu metody krytycznej analizy tekstów źródłowych, podstawowe elementy definicji instytucji wraz z jej ontologicznymi i epistemologicznymi założeniami dotyczącymi pojęcia prawa i metodologii badań prawniczych. Druga część artykułu przedstawia krytyczny wkład teorii M. Hauriou w odniesieniu do wybranych podstawowych pojęć prawa publicznego i konstytucyjnego jako sprzeciw wobec tradycyjnych, normatywistycznych i pozytywistycznych ujęć konstytucjonalizmy.
