Law is a system of norms developed and/or recognized by the state as norms guiding human behaviour according to the values of that particular society, establishing rights and obligations, principles and definitions, structures and relationships of social organization and activity that must be obeyed and which, when necessary, are insured by the coercive force of the state. Thus, the development of this system of norms is not an end in itself, but is intended to regulate all social relations, guide human behaviours and achieve the aims of the law. The enforcement of law is the process of translating legal rules into practice, through which the subjects of law obey and execute legal norms, and state authorities apply them, depending on their competence. The enforcement of law depends on a number of factors that shape law, such as its natural framework of existence, the historical context and the ethnic and national particularities of that community’s development, the economic factor or framework, the framework and particularities of the political system, the cultural-ideological framework or factor, the international framework or factor, etc.
The paper strives to answer a seemingly apparent question about permitted and forbidden behavior in law. The aim is to show that the answer is complicated not only due to the fact, that law is a very complex system of legal rules. The true nature rests in fact, that rules comprised in law are quite often deliberately challenged by their recipients. The paper strives to show the cause and present examples. Inter alia, there is tension between the concept of democracy and concept of human rights present in the background.

Coming from a more comparative point of view as far as Theology of Religions and Interreligious Studies are concerned – though to a certain extent as well as a pluralist in the sense of hope for universal understanding and well-being – I want to ask how Interreligious and Intercultural Hermeneutics are a necessary tool when we try to set up minimal standards for a Global Ethics in the reality of nowadays multicultural societies. I introduce for Ethics as well as for Hermeneutics the concept of ‘Responsible Interim’ – the latter reflecting the fact that human beings do have universals only under the ‘eschatological reserve’ (in Christian terminology), as ‘Suchness in Emptiness’ (in Buddhist terminology). I will proceed from universal truth questions and more general questions of philosophy of religion towards questions of cultural i.e. religious contexts shaping ethical and religious view(s) and convictions. Can smallest common denominators be found? How does legal rule help to establish and keep them? How does society, how do individuals change by starting from a spiritual, creative and holistic and maybe even transpersonal point of view – a view of co-creation and incarnatio continua in religious, i.e. in Christian terminology again?
The aim of the study is to examine the question of the substantive scope of the in dubio pro reo rule, i.e. the determination of a decades-long dispute whether the order to decide irresolvable doubts in favour of the accused, as expressed in Article 5 (2) of Polish Code of Criminal Procedure, also concerns legal matters, or whether it should only be used to clarify factual doubts. This article is a first comprehensive analysis of this issue. It sets out all the arguments put forward so far for each of the opposing views, as well as a number of own arguments which have not yet been taken into account. The first part of the text examines, inter alia, the legal nature of the in dubio pro reo directive, in particular its relationship with the presumption of innocence. The following section examines, inter alia, the impact of successive changes in criminal procedural law on solving the problem of the scope of the rule in question and compares the directive with similar rules in other fields of law.

W pierwszej części tekstu analizie poddano m.in. charakter prawny dyrektywy in dubio pro reo, w tym zwłaszcza jej związek z zasadą domniemania niewinności.
This scientific research-based article aims to analyse resolutions and rulings of the Supreme Court Criminal Chamber concerning substantive and procedural criminal law issued in 2020 as the response to the so-called legal questions. They concerned liability for false testimony (Article 233 § 1 CC), representation of a minor by one parent in case the other one is a defendant (a suspect) (Article 51 § 2 CCP), violation of rights of a person who has reported crime resulting from the commission of an offence (Article 306 § 1 (3) CCP), a person unauthorised to judge (Article 439 § 1 (1) CCP), specific legal questions (Article 441 § 1 CCP), counting already executed separate but identical penalties towards a combined sentence (Article 577 CCP), reopening of a proceeding due to the commission of an offence connected with the proceeding (Article 540 § 1 (1) CCP), a concept of ‘expenditures necessary to issue an opinion’ (Article 618f § 1 CCP), referring a legal issue by the Supreme Court to be solved by seven judges of the Court (Article 82 Act on the Supreme Court), resolutions having the power of legal rules (Article 87 § 1 Act on the Supreme Court) and a complaint about decisions of execution bodies (Article 7 § 1 CPE). The research basically aims to evaluate the legitimacy of this body’s interpretation of the regulations covering the legal issues referred to the Supreme Court for resolution. The main research theses consist in showing that the so-called legal questions referred to the Supreme Court play an important role in ensuring the uniformity of common and military courts’ judgements because the body’s stand is based on in-depth reasoning. The research findings are original in nature as they creatively develop the interpretation contained in the resolutions analysed. The range of the research is mainly national. The article is especially important for science because it contains a deepened dogmatic analysis and a big load of theoretical thought as well as it is practically useful as it enriches the Supreme Court’s arguments or refers to circumstances justifying different opinions.

306 § 1 pkt 3 k.p.k.), osoby nieuprawnionej, do orzekania (art. 439 § 1 pkt 1 k.p.k.), konkretnych pytań prawnych (art. 441 § 1 k.p.k.), zaliczenia na poczet orzeczonego łącznego środka karnego odrębnie wykonanych tożsamych rodzajowo środków karnych (art. 577 k.p.k.), wznowienia postępowania z powodu popełnienia przestępstwa w związku z postępowaniem (art. 540 § 1 pkt 1 k.p.k.), pojęcia „wydatków niezbędnych do wydania opinii” (art. 618f § 1 k.p.k.), przedstawienia przez skład Sądu Najwyższego zagadnie-nia prawnego do rozstrzygnięcia składowi 7 sędziów tego sądu (art. 82 ustawy o SN), uchwał o mocy zasad prawnych (art. 87 § 1 ustawy o SN) i skargi na decyzje organów wykonawczych (art. 7 § 1 k.k.w.).
