W artykule przytoczono stan faktyczny opisany w wyroku Sądu Okręgowego Warszawa-Praga w Warszawie z dnia 24 maja 2022 r., sygn. akt: IV Ca 752/21. Aspekty te będą podlegały szeroko omówieniu i ocenie w ramach niniejszych rozważań.
The purpose of the article is to research the nature of the projected package travel directive and its aims, scope, as well as the specific terminology, and to point out their importance for the future of tourism in the EU and in Poland. The author analyses the proposal of the European Commission for a directive of the European Parliament and of the Council on package travel and assisted travel arrangements of 9 July 2013, and the European Parliament legislative resolution of 12 March 2014, with relevant documents applied in the legislative proceedings by EU institutions and the Polish organs. The article presents the issues of maximum nature of the projected directive and its still undecided scope. It also signals difficulties and consequences concerning imprecise terms used in that project. The author expresses his conviction that the discussed directive will be accepted by the European Parliament and the Council not earlier than in 2015, while the first positive outcomes of these regulations for tourism in the EU and Poland will be perceivable after the implementation of the directive by the EU member states, probably not earlier than in the second half of 2017.
In the article, the authors discuss the admissibility of conducting class action proceedings in the event of the insolvency of a travel and tour operator and/or of a business facilitating the purchase of linked travel services. In particular, consideration must be given to identifying the entity against whom such a claim may be brought. Secondly, the effectiveness of such a solution and its admissibility in the context of current statutory solutions should be analyzed. The article also includes de lege lata and de lege ferenda considerations.

Autorzy artykułu podejmują rozważania na temat dopuszczalności prowadzenia postępowań grupowych w przypadku niewypłacalności przedsiębiorcy turystycznego – organizatora turystyki i przedsiębiorcy ułatwiającego nabywanie powiązanych usług turystycznych.
The Act of 7 November 2025 amending the Act on Package Travel and Linked Travel Arrangements introduced a fundamental change that allows a tour operator to fulfil the requirement of a minimum guarantee amount by concluding several guarantee agreements. Comments submitted during the legislative procedure included, among others, proposals regarding the method of designating the primary guarantor. This issue was clarified by indicating that the entity responsible for receiving notifications from travellers is the one specified in the guarantee agreement. On this basis, the template of the guarantee agreement will have to be amended in accordance with the statutory delegation. The regulations in question are administrative in nature, as they concern the fulfilment of requirements for conducting business activity as a tour operator. This article discusses the consequences of the introduced changes from the perspective of public administration bodies, which will be obliged to adopt a new approach in this regard. It should also be emphasised that the existing legal regulations for both insurance and banking sectors remain unchanged: merely the possibility of a new method of contracting by splitting the guarantee is introduced, which may serve as an alternative to the previously existing single guarantee.

The main aim of the article was to identify changes in the purchasing decision-making process of holiday package buyers as a result of the COVID-19 pandemic. A query of the scientific literature was carried out, as well as research on the buyers of tourist services (N = 1502) on the issues of travel before and during the pandemic was conducted. The data was collected using the indirect survey technique, i.e. computer assisted web interview (CAWI), and the methods of descriptive statistics were used for their analysis. The obtained results made it possible to acquire new knowledge about the behaviour patterns of buyers of packaged holidays and to distinguish four segments of the tourists. The categories of buyers’ behaviour most frequently represented in the study (in total almost 95% before and slightly over 92% of indications during the pandemic) confirm the role of the Internet in the purchasing processes of travel agencies customers and the tendency of progressive virtualization of buyers’ behaviour in the tourist market. During the COVID-19 pandemic, in the case of the purchase of holiday packages, it was observed that the buyers transfer the entire purchasing process to the Internet much less frequently than before its occurrence, i.e. they both look for information about travel agencies offers and make purchases on the Internet.

The history of the Branch of the Polish Tourist and Sightseeing Society in Racibórz, as this is its full name, had a huge impact on the lives of the inhabitants of the Racibórz region. I can tell it very briefly, using mainly the calendar and extracting the most important information about what I was trying to accomplish. I think that further information will be included in a more extensive edition during the celebration of the 70th anniversary of the founding.
