Registrované partnerství a homoparentalita v Česku

This paper introduces a unique and comprehensive sociological analysis of same-sex partnerships in the Czech Republic, especially in the legally recognised (though limited) form of civil unions (registered partnerships – RP). The analysis combines multiple data sources and methodological approaches, drawing on administrative data from the Ministry of Internal Affairs (n=2710), secondary quantitative data from the Czech Statistical Office and Public Opinion Research Centre/CVVM, and original quantitative (n=882) and qualitative (n=48) data. Focusing on the heteronormative framing of the issue, two main aspects come to the forefront: gender and LGBT parenting. Data show that there has been a small but steadily growing amount of interest in RP, especially among women, in the last six years. However, RP remains very selective and quite ‘unpopular’. Although there has been a weakening of the procreative function of marriage, the role of RP in this respect is less clear-cut. On the one hand, it makes some paths to becoming a parent more difficult, while on the other, for some people, it provides a certain symbolic security for their existing family. The article also explores other gender and age characteristics and differences or similarities to marriage.

Civil partnerships legalization requires an opinion based on ethics as well as based on analysis which makes possible to describe the results and measure costs of the introduction of civil union to Polish law-system. Economic analysis seems to be a proper way to achieve that. Civil partners possess attributes typical for homo œconomicus - rational man/consumer. They owe individual preferences which enable them to impute specific usabilities to benefits (material, fiscal) and costs of living in civil union or being a single. They make a decision based on this analysis if they should contract a civil union or not. They can do it because of real need and emotional relationship or because of premeditated fiscal abuse. Some groups of potential civil partners are specially receptive to "moral hazard". Collective taxation of domestic partners can mean for the National Treasury a principal loss of some part of tax revenues. On the other hand, the amount of tax which has been saved can be reserved for consumption and stimulate the national economy. The scale of this phenomenon will depend on the number of people who want to be partners in civil union, on their incomes and on the national economic condition. Domestic union formed by civil partners will be characterized by some attributes which were described by Gary Becker - an economist and Nobel Prize winner in 1992. Homosexual partnerships will be distinguished in economic specialization from heterosexual couples. Prepared analysis has got a basic goal to signal and describe some mechanisms and results of civil unions legalization. For sure it will be urgent to complete it in the future.

Artykuł ukazuje ewolucję orzecznictwa ETPCz w zakresie wykładni artykułu 8 Europejskiej Konwencji Praw Człowieka i Podstawowych Wolności.

My paper is a reply to a note by Tomasz Sieczkowski “Discrimination nonetheless. A reply to Krzysztof Saja” [ICF Diametros (36) 2013], written as a reply to my paper “Discrimination against same-sex couples” [ICF Diametros (34) 2012]. The purpose of the paper is to refute Sieczkowski’s objections that rely on a wrong interpretation of the structure of my main argument. I will describe the proper structure of the reasoning that I offered in the first article and undermine Sieczkowski’s proposal to justify gay marriages by referring to values such as dignity, freedom and equality.

The aim of the article is to present a broad understanding of the problem of transcription of the birth certificate of a same-sex couple’s child. Reflecting on this topic, it should be emphasized that the most important thing for a debate on this issue is the best interests of the child, closely related to human rights. The article shows that the best interests of the child should take precedence over ideological issues. The study shows that due to the lack of transcription, the child is treated by public authorities as a “category B” citizen, and the practical aspect of having a Polish birth certificate is extremely important in everyday life. The main axis of the study is based on the arguments of opponents and supporters of the above-mentioned transcription, with a particular understanding of the constitutional and legal notion of family. The conducted analysis of the jurisprudence shows a different approach to the admissibility of transcribing the birth certificate of a child of a non-heteronormative couple. The article also shows the proper position of the Ombudsman in overseeing the observance of basic human rights.

In my paper I discuss the argument that the absence of the legal possibility to contract same-sex marriages is discriminatory. I argue that there is no analogy between the legal situation of same-sex couples and African-Americans, women or disabled persons in the nineteenth century. There are important natural differences between same-sex and different-sex couples that are good reasons for the legal disparities between them. The probability of having and raising children is one of them. Therefore, demanding that same-sex couples have rights similar to those that married couples currently have in Poland and justifying that claim by alleged discrimination is neither correct nor fair.

This article examines the interaction between national constitutional definitions of marriage and European Union law, with particular attention to the significance of the Court of Justice’s Coman ruling. Although Poland and Lithuania constitutionally define marriage as a union between a man and a woman, EU free movement law obliges Member States to recognise same-sex spouses for the purpose of derived residence rights. The article analyses the impact of Coman on the jurisprudence of the Lithuanian Constitutional Court and explores the regulatory challenges emerging in Poland resulting from the ruling’s narrow scope and the gaps in national legislation.

The article is an analysis of the rights which can be exercised in Polish criminal proce- dure by same-sex couples joined in a civil union. The key idea of the deliberation is an assertion that in criminal procedure – on account of the so called criminal procedure relation – the rights of people joined in same-sex unions are protected well enough, therefore alterations to the presented regulations are unnecessary. The authors make an argument, starting with demonstrating the legal definition of a closest person, next describing the following laws: the right to access the files of a case, the right to refuse to testify, the right to be excused from testifying, the right of succession after a deceased party of the proceedings, the right to appointed counsel, the right to apply for remand of a suspected person, the right to be notified of a preventive detention and to deposit bail, and to take part in a trial.
