Kritický nástin politizace soudní moci

100%
EN
The paper deals with judicialization of politics. In constitutional democracies, the political system is limited by the legal framework, which is usually enforceable before court. The courts, therefore, by definition, to a certain extent co-decide on the form and content of policy. The current radicalization of society is, in my opinion, largely caused by the depoliticization of the public affairs. The role of judges on the other hand cannot be overstated. Here I present a critical perspectives on the role of judges in the political process. My aspiration is not to present an absolutely objective account of the issue, but to present and defend critical arguments intended to be an incentive to launch a debate on the outlined issues. I present this process as a risk to the current political system, which limits politics and the public in their ability to decide on important societal issues and subsequently to accept responsibility for these decisions. My article should not be seen primarily as a critique of judicial power; but as a warning against the weakness of the political environment, which results in the politicization of the judiciary, which brings substantial risk nationwide.

Má práce se věnuje politizaci moci soudní.V ústavních demokraciích bývá politický systém ohraničen právním rámcem, který je zpravidla vymahatelný před soudem. Soudy proto z povahy věci v určité míře spolurozhodují o podobě a obsahu politiky.

This article presents a multidisciplinary study in the field of constitutional theory on the interconnectedness of national identity, shared myths and liberal constitutional democracy. We start from the political- philosophical perspective that democracy is inherently a form of government with self-destructive tendencies and that institutional safeguards alone are not sufficient to resist them. However, we believe that the democratic culture on which all democratic institutions and practices are ultimately built could be the answer here. We identify the form of national identity and national myths as a critical component of democratic culture, provided that they serve the image and practice of democracy. We link these conclusions to the societal role that the constitution and its actors play, especially the role of the president of the republic. We use the example of TGM to show what a practice of cultivating democratic myths may look like. Our core argument is that without a democratic national identity, which is directly derived from shared democratic myths, democracy cannot function in the long run.

The article deals with the current state and development trends of freedom of expression in the Czech Republic. It is based on an observable trend of gradual restriction of this fundamental freedom and identifies the main cause as the growing fear of disinformation, hate speech and other security threats. The article interprets this development through two key concepts – the securitisation of law and the culture of fear. Securitization of law refers to the tendency to transform societal problems into security issues, opening space for the expansion of state regulation at the expense of individual rights. The culture of fear then creates an environment in which public debate is dominated by fear, which legitimises restrictive measures. The article builds on The Future of Free Speech’s international research (2015–2022), which confirms the global trend of restricting free speech in democratic countries. The analysis focuses on specific legislative acts concerning the Czech Republic. The research part is based on case studies that show how threats are constructed and used as a basis for restricting free speech. The article draws attention to the absence of counterbalancing liberalisation measures and warns of the long-term consequences of unilateral regulation.

Článek se zabývá aktuálním stavem a vývojovými trendy svobody projevu v České republice. Vychází z pozorovatelného trendu postupného omezování této základní svobody, přičemž za hlavní příčinu identifikuje narůstající obavy společnosti z dezinformací, nenávistných projevů a jiných bezpečnostních hrozeb. Článek navazuje na mezinárodní výzkum organizace The Future of Free Speech (2015–2022), který potvrzuje globální trend omezování svobody projevu v demokratických zemích.

This article explores the transformation of civil dispute resolution in the context of digitalisation, with particular emphasis on its implications for due process guarantees and judicial decision-making. It analyses key stages of civil litigation affected by technological change, including the digital initiation of proceedings, electronic court files, remote hearings, automated decision-making tools, and the increasing use of artificial intelligence both in courts and in alternative dispute-resolution mechanisms. The article argues that digitalisation is not a merely technical process but a normative intervention that directly affects fundamental procedural principles, especially equality of arms, adversarial proceedings, transparency, effective participation, and the right to a reasoned decision under Article 6 of the European Convention on Human Rights. Special attention is devoted to “in extremis” situations, where digital substitution becomes operationally necessary and the outer limits of lawful procedural adaptation must be tested. The article concludes that further digitalisation and automation of civil justice are inevitable, but must be accompanied by robust legal frameworks, meaningful human judicial oversight, and procedural safeguards ensuring fairness, legitimacy, and proportionality.
