The article addresses conceptions of legitimate expectations, legal certainty and principles of legal safety, as well as the relationship between them and the reform of higher education in Lithuania. The article inquires into the approaches of Lithuanian students to higher education reform. One of the main reasons for the reform of higher education in Lithuania is that the state has limited possibilities to fund all those interested in university education. Under the Lithuanian Constitution, "Higher education shall be accessible to everyone according to his individual abilities. Citizens who are good at their studies shall be guaranteed education at State schools of higher education free of charge." The guarantee of the studies free of charge should be based on state and public interest - e.g. the need for specialists in different spheres. This paper focuses on the aspects of reform connected with the constitutionally guaranteed right to a free of charge higher education for the students that show good achievement results and also to the aspect of the fixing of fees for students not funded by the government. The results of the survey show that the majority of respondents did not understand the aims of the reforms conducted by politicians, which makes it difficult to feel secure about the future of Lithuanian high schools. The conclusions offered here are that the reforms enacted in Lithuanian higher education, in particular in connection with tuition, are only partially linked to the principles of legitimate expectations, legal safety and legal certainty. The fact that the Law of Higher Education and Studies, as initiated during the reform, is applied only for new entrants to the colleges and universities is assessed according to the principle lex retro non agit, but the fact that there were no concrete objectives to the reform, which itself was followed by changes in legal regulation, made students feel a lack of legal safety and legal certainty.

The aim of this paper is to provide an analysis of the commitments procedure under the Polish competition law, including both legal and economic perspective. The outcome of this research is supposed to help in estimation whether novel negotiated instruments may be successfully employed in the field of antitrust enforcement. Hence, the paper first introduces the legal background of the commitments decisions, with focus on the specific features of the procedure. Being a tool of antitrust enforcement, commitment decisions should contribute to its goals. Therefore, the paper identifies such objectives drawing on the economic literature. It is in the light of these criteria that the decision practice of the Polish competition authority, still in the stage of development, is subsequently evaluated. This assessment reveals circumstances, under which the competition authority is particularly apt to engage into commitments procedure. It allows also for a conclusion that the application of this negotiated instrument is in principle commensurate with the exigencies following from economic theory.

The article identifies and assesses the different ways in which the Court of Justice of the EU (CJEU) has eroded its own general limits of the direct effect of EU directives. The article argues that while these different ways of erosion extend the admissibility of the direct effect of EU directives, they do so at the cost of significantly weakening legal certainty of the persons concerned, making these erosions highly questionable. The article highlights and criticises the most questionable form of such erosion, that emanating from the Mangold and Kücükdeveci line of case law of the CJEU. The article concludes that an adequate response to these questionable erosions should not be the acceptance of a general admissibility of the horizontal direct effect of EU directives. Rather, the response should be based on various efforts to reduce the occurrence of situations of improper transposition of EU directives – the main trigger for the direct effect of EU directives. These efforts should be accompanied by a comprehensive review of the Mangold and Kücükdeveci line of case law and a further clarification by the CJEU of the limits of the (in)admissibility of the direct effect of EU directives, which would considerably increase legal certainty for the persons concerned.

This paper presents the main ideas behind a new type of resolution, which, according to the proposed amendments to the Law on Proceedings before Administrative Courts, would be passed by the Supreme Administrative Court. The purpose of so-called pilot resolutions would be to prevent inconsistency in rulings concerning cases that are identical in legal and factual terms. In the concluding remarks, we underline the positive aspects of the proposed changes and argue that their incorporation into the existing system would enhance legal certainty and increase the predictability of judicial decisions.

Legal certainty is one of the fundamental values of a democratic state governed by the rule of law, and striving to achieve it at the highest possible level is highly desirable. An essential factor influencing the degree of legal certainty is the predictability of judicial decisions. This is particularly significant for taxpayers, as it reduces the level of legal uncertainty. It is also relevant from a macroeconomic perspective, as a lack of legal certainty hampers a country’s potential for growth. This paper analyses the state of Polish administrative courts’ practice of interpreting tax law, which the authors consider unsatisfactory. It also offers a critical review of selected scholarly views on specific issues related to the core subject addressed.

Although the general principles of law at first sight do not bring about numerous associations with the sphere of taxation where the processes of compliance with legal rules or applying them must end with a precise numerical result, both the relevance and the significance of these principles in the sphere of tax law are more and more noticeable. The principle of proportionality has been invoked in probably every second VAT judgment of the Court of Justice for years. The principle of legal certainty has made its way to the case law of the said court as well as the Constitutional Tribunal in Poland. The importance of other principles is definitely on the rise.

The principle of non-retroactivity of the civil law has its fundament in ensuring the security of the civil circuit and in its compliance with the rights and legitimate interests of the subjects of law. After 1991, the Romanian legislator has chosen to constitutionalize the non-retroactivity of the law, stating a single exception, namely that of the criminal or administrative law more favourable. Therefore, the principle has acquired a mandatory feature, both for the legislator, for the law enforcement organs, as well as for other participants in the judicial circuit. In its turn, the Romanian Civil Code of 2011, by preserving the tradition of the Civil Code of 1864, expressly states the non-retroactivity of the civil law. Thus, the non-retroactivity is configured as a guarantee of the stability of the state of law, of the constitutionality, an essential guarantee of the constitutional rights and, especially, of the personal freedoms and safety.

The paper argues that the multilingualism of the EU legal order should be viewed from the point of view of the right of individuals to acquaint themselves with the their rights and duties under EU law in the official language of their Member State. In case of discrepancies of equally authentic versions, individuals should have the possibility to rely on an ‘authentic version’ defence, especially in tax, customs and criminal law relationships.

Pandemic-induced economic shocks saw the European Commission and national competition authorities adopt so-called comfort letters to provide guidance, assurance, and legal certainty to undertakings in order to help mitigate the detrimental effects of the crisis. Whereas it is true that desperate times may call for desperate measures, the fact that the Commission continues to issue comfort letters for initiatives with little relevance to the ongoing emergency raises questions. This article analyzes the re-emergence of comfort letters from the viewpoints of legal basis and certainty. It finds that the foundations upon which the letters are constructed are shaky, which translates into the fostering of uncertainty. In that regard, explored are alternatives for Union enforcers to deploy a robust bespoke guidance regime for the future.

This article discusses external openness of criminal proceedings in respect of legal security. The realization of such openness is done through the statutory permission to record and broadcast a hearing which is granted to representatives of the mass media. The article also attempts to assess amendments to article 357 of the Code of Criminal Procedure (2016) in terms its realization of the idea of legal security. The author gives a positive assessment of the direction of changes in the Polish law; however, she also tries to identify the legislation which could undermine legal certainty, and thereby negatively affect the possibility of realising the concept of legal security in the context of criminal law.

The purpose of this paper is to present the issues of legal protection within inheritance law. A court decision made in the case of the ascertainment of inheritance, acquisition, or registered deed of succession, constitute the only proofs of legal succession, so their amendment or revocation is permissible only in the special cases indicated in the Act. Time and procedure limitations on amendments in respect of succession can potentially affect the accepted principle of justice. However, the State protects inheritance law and at the same time upholds legal protection. The fact that the legislator facilitated such a mode of procedure attests to the fact that legal stability and security of transactions are valued more than the protection of legal succession. However, this does not mean that the principle of justice and the protection of legal succession are not applied. Au contraire a person who is not a successor has the possibility to assert the protection of his/her rights at a particular time. On the other hand, the person who is a successor has to invoke the statutory presumption and has to have the sense of legal security guaranteed by the legislator which is required of him/her. As a consequence the conflict between the protection of legal succession and legal security arises. This presents the opportunity for reflection on the status of Polish inheritance law which will be provided in this article.

The author deals with some of the values that are more or less manifest in Slovakia in the field of taxation, and which should also more manifestly absorb the tax law into its normative base. Before focusing on the topic itself, the author formulates, albeit in brief, his idea of the fundamentals of values in society. He emphasizes the idea that every individual understands values differently, with due regard paid to what is ethically correct/incorrect, beautiful/ugly, desirable/undesirable, advantageous/disadvantageous. This means that each person would hold their own view of what the values are. In the following text the author emphasizes the idea or the thesis that the value system of society is necessarily transformed into the value system of law. In relation to the issue of value-related issues examined, he focuses on such important values as taxation fairness, equality in taxation, non-discrimination, interests, taxation morality, legal certainty or transparency of taxation. Except for interests, he considers the other examples of the value to be the values of ideological or "noble" meaning. He points out how these values are transformed into the tax system and tax legislation in Slovakia. In relation to values, he emphasizes the idea that they should be regarded as the basic pillars of relationships in which each society, thus also the Slovak one, should be created and further shaped. In conclusion, and in line with other authors, he argues that values also represent a cultural legacy that is not automatically transferred from generation to generation, but each individual has to acquire them repeatedly, take a personal stance, and decide for themselves. In this way, the values that a majority society recognizes in tax law may not be positive for a particular individual, and vice versa.

Certainty in law is a commonly used expression, but attempts to find its definition may turn out fruitless. It appears in scientific articles, goals of legislation and case law, but those use instances are not always coherent. This study aims to describe certainty in law, based on how it is interpreted in European case law, studies on legal certainty, and contract theory. At first, examples from judgments of the highest courts, in which predictability of economic relations and legal certainty occur, will be presented along with the potential dangers of improperly differentiating between the two. In the second part, a review of how certainty is described in different legal systems and contexts is provided, followed by arguments on the independent existence of concepts of legal certainty and certainty of economic relations. In the end, certainty will be described as a decisionmaking factor. A decision-making factor that may have varying degrees of significance for different entities – one for consumers and another for professional entities. The differences between professional entities and consumers will be highlighted throughout the paper to assess what role legal certainty and certainty within private legal relations play for consumers.

Wątek różnic w podejściu podkreślany będzie przez całe opracowanie, by rzetelnie ocenić, jakie znaczenie mają pewność obrotu i prawa z punktu widzenia interesu konsumentów.

In this speech I will present the role and importance of the Constitution of the Republic of Poland in maintaining certainty and stability of the law and system. Considerations in this regard will serve to verify the thesis that the duration of a pandemic is not appropriate for making changes. Then, the arguments justifying the thesis will be presented, based, on the one hand, on the history and reality of the extraordinary situation that occurs - the pandemic, and on the other hand, based on the legislative experience from the period of the ongoing pandemic. Their examination will allow to highlight the doubts related to the amendment of the Basic Law in a specific, extraordinary time - the period of the pandemic, and the shortcomings of the legislative mode, which was used by the legislature during the pandemic.

Referring to Józef Nowacki’s research on the principle of non-retroactivity of law [lex retro non agit], the authors of this study focus on the relationship between legal certainty and retroactive changes in the prevailing interpretation of legal provisions. The main topic of the study is the expression ‘interpretatio retro non agit‘, which is already well-known in the legal culture, but not widely used. The objectives of the study were: (1) to determine the content related, or potentially related, to the statement above in case law and literature; (2) to examine whether there are grounds to consider this principle as binding in adjudication; and (3) to explain why changes in the prevailing interpretation of legal provisions are perceived as a necessary evil. The research gave the authors a basis to distinguish between two understandings of the interpretatio retro non agit principle: the narrow one and the broad one. Moreover, the broad understanding contains four sub-types of the thus understood principle. The narrow approach prohibits recognizing a change in the prevailing interpretation as a circumstance that would allow legally valid court judgments or final administrative decisions to be challenged. On the other hand, the broad approach introduces a presumption that legal effects should not be ascribed solely because of a change in the prevailing interpretation that occurred after the legal fact took place. Four possible justifications for the interpretatio retro non agit principle were also considered: formal, natural, cultural, and instrumental justification. The authors found that the instrumental justification, which connects the principle with the value of legal certainty, seems to be the most appropriate. However, some elements of the principle can also be convincingly justified formally. Retroactive interpretation changes are only briefly discussed in literature, which the authors regard as an unfavourable state of affairs. However, the fundamental differences between law-making and the application of law allow us to understand that protecting the addressees of the law in practice is much more complicated in cases of applying the law.

W nawiązaniu do badań Józefa Nowackiego nad zasadą lex retro non agit, autorzy artykułu podjęli refleksję na temat związków pomiędzy pewnością prawa a retroaktywną zmianą dominującej w praktyce wykładni przepisów prawa. Głównym przedmiotem zainteresowania uczyniono sformułowanie interpretatio retro non agit, funkcjonujące w kulturze prawnej, choć nieznane powszechnie we wspólnocie interpretacyjnej. Badania dały podstawy do wyróżnienia wąskiego i szerokiego ujęcia zasady interpretatio retro non agit, z dalszym powiązaniem z szerokim ujęciem tej zasady czterech jej możliwych wariantów.

The position of the administrative judiciary, as it has functioned since 2004, situates this institution not only as a guarantor of the legality of public authority action in a given case, but also of the coherence and functionality of the administrative law system as such. The protection of the legal order by administrative courts is naturally related to the issue of the stability of the judicial practice and the responsibility of the judge for the content of the ruling, and further to the effectiveness of the judicial-administrative application of the law. Thus, this issue is situated on the edge of different methodological planes, covering such threads of analysis as: the place and role of administrative courts in the modern legal order (constitutional-legal method), the procedural model of judicial application of law and its effectiveness (administrative-legal method), or theoretical and even ethical-legal aspects of judicial application of law. In the light of the decisional model of judicial application of law, the issue of care for legal order is revealed with particular force in the layer of validation and interpretation findings, which gives significant importance to the reasons for the justification, especially if one takes into account that the execution of the decision in principle remains outside the competence of the administrative court. Against this background authors pay attention on the relatively restrained use of reformatory powers and disciplinary measures by administrative courts, as a kind of last resort legal remedy. This allows to maintain thesis that administrative courts generally protect the legal order with the force of arguments rather than with the argument of force. On the other hand, they treat measures to ensure the certainty and effectiveness of decisions of judicial application of law as measures to protect the legal order.

The sources of the principle of certainty constitute the first phase of the search for answers about the purpose, understanding and practical application of the principle. The basis for the considerations in the subject matter is primarily the Polish Constitution, the case law of the Constitutional Court and the much more modest achievements of the doctrine. Because the principle of certainty does not only bear its legal aspect but also the linguistic one, the literature within the scope of linguistics has been also taken into consideration. In its legal aspect, the principle encompasses its relation to the law in general and as well as its axiological and normative foundations. The principle of certainty is undoubtedly a legal issue. It arises from the very concept of law, as certainty is an inherent feature of the law, especially of positive law, and hence its linguistic aspect. The principle of certainty in the axiomatic foundations protects human dignity setting out the framework for the activities of the state in the sphere of the regulation of restrictions of rights and freedom, the protection of which is an integral element of the rule of law. It is the guarantor of the implementation of the idea of lex est rex, which is a determinant for a constitutional clause of the rule of law. To provide effective protection to the citizen against the omnipotence of the state, the principle had to obtain the rank of a constitutional one, while in order to pursue its practical objective, the rule of law must obtain a linguistic dimension. Thus, the principle of certainty being a legal category cannot exist outside the language realm. Defining is primarily a linguistic activity. The linguistic aspect of the principle of certainty allows to determine a clear boundary between what is and is not lawful, a boundary which forms the basis of the principle of ignorantia juris non excusat. The principle of certainty in its axiomatic foundations protects not only the dignity of a man, but also the balance in the functioning of the state. A failure to implement the rigour of the principle of certainty in the sphere of the regulation of restrictions of rights and freedom causes confusion and fear of an unidentified threat. It suggests that the rights granted are only apparent. The principle of certainty as a value is therefore a guarantee of legal security and its implementation is an act of loyalty of the state authorities to the citizen. Conclusively, there arises an assumption that a lack of a regulation is always a conscious action of a rational legislator, therefore the silence of a legislator regarding rights restrictions means that such restrictions do not exist.

The article discusses the role of precedents in the German judicial practice. In the European continental tradition, law enactment is within the legislature, whereas the role of the judiciary is to enforce law. In the continental system, precedent does not constitute a source of law sensu stricto, that is, a formal source of law. In order to guarantee the law utility and, ultimately, the legal certainty, courts interpret legal provisions in a unified manner. It is noteworthy that during the recent years the coherent interpretation of legal provisions and, by the same token, the commitment to law development, have increased. That means that a unified interpretation of law performed by courts may be considered a precedent. In this context, precedents and stare decisis have been replacing the logical interpretation of law in German courts.
PL

In the aforementioned article there were introduced to scientific discourse new categories, namely category of passive subject of legal security and category of active subject of legal security. The need to introduce these categories revealed in the course of the discussions on the concept of legal certainty. The purpose of this article is to answer the question ‘who and why it is the passive subject of legal security, and who the active subject of legal security is’. In addition, consideration is given to whether the passive subject of legal security in certain circumstances acts as the active subject, and vice versa – whether the active subject of legal security may be the passive subject of legal security. The author argues that the passive subject of legal security is first of all every human being. The sovereign is primarily the active subject of legal security. However, there are circumstances in which the passive subject also (to some extent) plays the role of an active subject, and the active subject turns out to be also the passive subject of legal security.

W niniejszym artykule wprowadzone zostały do dyskursu naukowego nowe kategorie, a mianowicie kategoria podmiotu biernego bezpieczeństwa prawnego i kategoria podmiotu czynnego tegoż bezpieczeństwa.
