The 2020-21 Covid 19 Pandemic has raised many legal challenges as governments world-wide have struggled to deal with the public health and safety challenges of Covid. At the center of many of these decisions is the need to balance public health protections against other rights that have been infringed by legislation related to Covid Pandemic restrictions. One of the most important rights that have been implicated by Covid restrictions in the United States has been in the area of restrictions on religious worship which implicates the right to freedom of religion as enshrined in the United States Constitution. During the time of the Pandemic the United States Supreme Court, as the final arbiter of the United States Constitution has had to work to balance the interests of the government in protecting public health and safety with the right to freedom of religion. The Supreme Court’s approach to these cases reflects the difficulties inherent in balancing two such important interests in difficult circumstances and also represents the reality of the shifting majority in the Court as a result of new Justices appointed under the administration of Donald Trump. The Court has transitioned from a majority that opposed restrictions on governmental action during COVID to a majority that is more willing to stop governmental action that is deemed to be in violation of the Free Exercise of Religion Clause of the First Amendment.

This paper investigates the interplay between judicial argumentation and evaluative or emotive language identified in two US Supreme Court landmark cases on the right of same-sex couples to marry. The analysis of both majority and dissenting opinions leads to two main observations. First, marriage and liberty are indeed emotive words and they represent two major sites of contention between the concurring and dissenting judges. Second, there are important differences within the argumentative strategies employed by the judges. While (re)defining the concepts remains the major argumentative goal for both types of opinion, the majority opinions tacitly integrate the redefined concept of marriage into their argumentation. It is the dissenting opinions that explicitly raise the issue of (re)definition in order to defend and retain the original sense of marriage.

The recast of the European Insolvency Regulation, which has been applicable from 26 June 2017, implements a philosophy of Euro universalism, according to which insolvency proceedings opened in a Member State where the debtor has its centre of main interests (COMI) should have a universal scope and encompass all the debtor’s assets situated throughout the EU. The wording of the Recast Regulation is intended to comply with the ECJ case law concerning COMI, such as Interedil, Eurofood, Bank Handlowy or Mediasucre judgments. Nevertheless, it is now questioned whether the Recast Regulation strengthens or rather weakens the COMI/registered office rebuttable presumption and opens the gate for insolvency forum shopping. As far as international company law is concerned, the issue of transfer of seat as well as forum shopping has been widely discussed. So far the ECJ has issued a series of judgments in which it has explained the European freedom of establishment and the crossborder activities of companies in the internal market. Similarly, the US Supreme Court has issued several significant decisions, such as CTP Corp. v. Dynamics Corp. of America, Edgar v. MITE Corp., and International Shoe Co. v. State of Washington, in which the limits of acceptable forum shopping are better delineated. Based on the aforementioned, it may be concluded that European harmonization measures facilitating crossborder mobility should additionally assist in achieving predictability and efficiency, as well as the economic viability and security of the operations under consideration. This contribution analyses and expounds on the lessons that can be learned from both the ECJ case law as well as US Supreme Court’s decisions on international company law, including an examination of their effect on insolvency forum shopping. There is no doubt that, if successful, harmonized legislation on these matters would be a great asset for the internal market.

In discussions about human rights, we often face a simplistic view: a certain right is either granted or not. W. N. Hohfeld’s analysis of subjective law shows that there are differences in the modalities of diverse “rights”: one term refers to completely different legal (and interpersonal) relationships. The text transfers this general knowledge into the context of debates on the conflict between the unborn child’s right to life and the woman’s freedom to manage her pregnancy according to her choice. It shows that even in a jurisdiction in which the right to abortion has been raised to the level of constitutional law, there is no consensus on what this right consists in. The author presents the most important decision of the US Supreme Court on the issue of abortions.

Judicial religious exemptions from general laws have become increasingly controversial in the U.S. This article examines changing understandings of religious exemptions in the Supreme Court’s jurisprudence. Part one discusses the unclear text of religion clauses of the First Amendment whilst part two focuses on doctrinal tensions and contradictions in the Court’s opinions, which show the inability to create a robust regime of religious exemptions. Part three follows the Court’s rulings on COVID–19 pandemic restrictions and reveals that replacing Justice Ruth Bader Ginsburg with Justice Amy Coney Barrett changed the meaning of the Free Exercise Clause. As Part four emphasizes, the American legal system was able to embrace religious exemptions, albeit in a highly limited scope, without courting anarchy. However, the recent trend of grounding religious exemption claims on the third party’s sinful behavior, especially in commercial settings, may prove a challenge to a religiously diverse society.

The subject of this article is the impact of public opinion on the judicature of the Supreme Court of the United States (SCOTUS), a topic that has thus far received limited attention in Polish legal scholarship. In a democratic system, public opinion has a decisive impact on the shape of political decisions, but certain spheres of social life are typically regarded as exempt from such influence. The judiciary is considered to be one of these spheres, and in a liberal democratic system, it plays the role of a guarantee of the rights and freedoms of individuals and the minorities against the ‘tyranny of the majority’ – a view that dominates in the American constitutional discourse. Based on an analysis of the literature from representatives of American legal, sociological and political discourse, two theories were presented to explain the essence of these relations. The first theory – the theory of attitudinal changes – assumes that the changes observed in social moods and changes in judicial decisions are not directly related but run parallel to each other, though under the influence of the same trends and social changes. The second theory – the theory of the strategic behaviour of the SCOTUS justices – posits a direct impact of social moods on the decisions of SCOTUS justices, who in the long term adapt their decisions to social trends. This does not mean that the SCOTUS cannot rule against social moods – it very often does so – but this results in a decrease in the level of its legitimacy.

Taka wizja relacji opinii publicznej w stosunku do orzecznictwa SN USA dominuje w amerykańskim dyskursie konstytucyjnym.

This paper adopts a comparative, corpus-based perspective to examine the language of judicial justification. Based on substantial corpus data, the study explores one of the linguistics resources, i.e. head nouns (e.g. assumption, belief, notion, etc.) followed by a nominal complement in the form of that-clause in two comparable legal settings: the opinions given in the United States Supreme Court and the judgements handed down by Poland’s Constitutional Tribunal. The findings corroborate the results of previous research which shows that nouns found in this pattern are used to perform various discourse functions but evaluation plays a central role in judicial writing and these nouns are used to signal sites of contentions. The study reveals the general similarity between the two sets of data suggesting that American and Polish judicial writing is underpinned by essentially the same epistemological assumptions. Yet, there are some differences in the way the nouns behave phraseologically. Polish nouns tend to show less collocational variation and they are found performing fewer discourse functions.

The aim of this paper is to compare the American and European standards of the inadmissibilityof evidence of unlawful police entrapment. In US criminal procedure, which permits activeforms of entrapment, the US Supreme Court and most federal courts apply a subjective test forthe entrapment defence, focusing on the predisposition of the person provoked to commit thecrime and, less often, an objective test examining the legality of government agents’ actions. The Strasbourg standard (including German cases) is based on two tests: a substantive one(examining both the predisposition of the person being provoked and the legality of the policeactions) and a procedural one, which consists in verifying the reliability of the national courts’recognition of the charge of incitement to commit a crime by the police The basic differencebetween the analysed standards is to be found in the effects of illegal entrapment. In the USsystem, it is a justification to the perpetrator’s responsibility for a crime committed as a resultof entrapment, and the Strasbourg standard allows for sanctioning the negative effects of suchillegal evidence to be convalidated in criminal trial when the Court considers that “the trialas a whole was fair”.

The paper shows an American model of the participation of the society in the administration of justice. It is crucial for the Polish discussion about the involvement of public factor in that manner. The analysis is divided between the constitutional right to trial by jury and the institution of justices of the peace, which is unique for the Anglo-Saxon legal system. Research conducted here is the result of a detailed analysis of the case law of the Supreme Court of the United States and selected state courts that shaped the views of the American academia on this issue. Hopefully, this brief study will help to reform the Polish judicial process.

A prerequisite for the proper application of the law is a certain definition of the terms used in the law. A variable definition of a concept undermines the requirement of legal certainty, and an overly narrow or broad definition of a concept (compared with the general idea of its content) may lead to doubts about the fairness of legal regulation. Although the legal system uses the term “religion” relatively frequently, it does not generally define it explicitly. In most cases, this does not cause problems because there is no reasonable doubt as to whether we are dealing with a religious element. In hard cases, however, there is no choice but to decide where to draw the line between religion and other types of beliefs. The alternative is to stop distinguishing between them, thus depriving the religious element of its special legal status. The social sciences distinguish four basic approaches to the definition of a religious phenomenon. The substantive definition seeks to capture the content that a particular belief must satisfy in order to be labelled religious. The essentialist approach emphasises the experience of the believer. The functionalist definition notes the function that religion serves in the life of the believer. The analogical approach does not seek to capture the essence of religion but rather notes its manifestations and what different religions have in common. This article offers examples of the application of these theoretical approaches in jurisprudential practice. It also highlights the fact that courts work flexibly with the concept of religion and often give it a different content depending on the context under consideration.
