The study aims on selected problems associated with appending the enforcement clause on the redress of damage in Polish Criminal law. The difference between the redress of damage as a penal measure and as a probationary measure outlined by The Polish Supreme Court is significant for the analysed perspective. The author indicates that the Supreme Court claims, that a probationary measure enforcement clause could be put on the redress of damage only after the expiration of a period of time appointed by the court to the perpetrator to compensate for the harm caused by a crime. Due to the outlined interpretation by the Polish Supreme Court the author finds the presented statement as not rightful due to the wrong interpretation of the law and flagrant infringement of rights of the victims of the crimes.
The purpose of this article is presentation of the exiting studies on the nature of individual crimes and identification of the main attributes of these acts. In the author’s opinion this subject matter has been neglected by scholars and therefore needs a more thorough analysis. First, the author points to the inaccuracies concerning the very name this category of prohibited acts has been given, and the abuse of the term ‘crime’ when referring to those acts. After that, he specifies which types of norms apply to these types of acts. He also describes the differences between individual and common crimes, and draws attention to the considerable heterogeneity of individual crimes, as can be seen from the quantity of various attributes describing the perpetrators of these crimes. The number of classes of prohibited acts that are similar to individual crimes is an additional proof of that variety. The next step is to show the essential differences between prohibited acts and individual crimes, asking a question, though, whether making such distinction makes any sense. Finally, the key issue, which is the specification of the distinctive features differentiating individual crimes, is addressed. These are the features that are primarily responsible for the possibility of committing or not committing of a crime by anyone, which possibility is of a nature independent of the perpetrator, but relative to his relationship with the external world.

The purpose of this article was to assess the legitimacy of introducing Article 244c into the Criminal Code. It provides for the possibility of punishing a person who evades to fulfill of a compensatory measure in the form of a duty to redress damage or make restitution, ordered by the court in favour of the wronged party, for a crime prosecuted by public indictment. The regulation was analysed using the formal-dogmatic method, in order to verify whether the introduced provision is consistent with other solutions of criminal law and whether it does not contain any constructional errors. As a result of this analysis, it was concluded that this regulation cannot be reconciled with the nature of redress damage as a compensatory measure. Overly far-reaching penalisation has led to excessive differentiation of the effects of imposing the duty to redress damage on the perpetrator as a compensatory measure and as an effect of allowing a civil action and has led to many systemic inconsistencies related to the imposition of the duty to redress damage in criminal law. The regulation itself, on the other hand, is not very precise and does not properly define when the offender’s fulfilment of the elements of this criminal act occurs, which is its fundamental error.

Celem artykułu było dokonanie oceny zasadności wprowadzenia do Kodeksu karnego art. 244c.
The article aims to evaluate the case-law concerning the situation of the purchaser of a debt resulting from a criminal offence in criminal proceedings and to present the author’s view on the possibility of resolving this issue. In the author's opinion, the reference of case-law theses to the content of the criminal and civil law provisions, when interpreted not only linguistically but also systemically, raises doubts as to the validity of the case-law positions. These doubts arise primarily from the juxtaposition of criminal and civil law provisions, which should also be applied when deciding on the obligation to make reparation. Meanwhile, according to civil law, the purchaser of a claim should acquire the same procedural rights as those of the seller. However, criminal courts do not apply civil law provisions in this regard, denying the acquirer not only the status of an injured party, but even the possibility to apply for an obligation to make reparation in their favour in a criminal trial. This position is the result of adopting a narrow interpretation of the definition of victim, which does not include the purchaser of a claim. The issue in question leads to real practical problems, as acceptance of the theses prevailing in the case-law may lead to harming the purchaser of the claim and unfounded, axiologically unjustified privileging of the offender. It should be noted, however, that while this problem is significant, it has not been the subject of frequent academic reflection. The case-law theses in question, despite raising substantial doubts, are often accepted in criminal law doctrine.

Omawiana kwestia prowadzi do realnych problemów praktycznych, ponieważ akceptacja tez dominujących w orzecznictwie może prowadzić do poszkodowania nabywcy wierzytelności i bezpodstawnego, nieuzasadnionego aksjologicznie, uprzywilejowania sprawcy przestępstwa.
The article is an analysis of the amendment to article 296 § 4a of the penal code, as a result of which the circle of entities that may file a motion for prosecution of the offence of criminal mismanagement without harm has been broadened. Prior to the amendment, only the wronged party had such a right; now it is also available to a partner, shareholder or stockholder of the wronged company or member of the wronged cooperative. The purpose of this analysis was to assess whether, in fact, this amendment was necessary and whether its introduction complied with the principle of subsidiarity of criminal law. In the author’s opinion, there is no sufficient justification for this amendment and its introduction appears to be the result of a faulty identification of the reasons for the rare application of the provision sanctioning the offence of criminal harmless mismanagement, which the legislator identified in the excessively limited circle of persons who may file a motion for prosecution of this offence. Meanwhile, in fact, the lack of practical application of this provision lies in its construction, which significantly limits the range of facts that we can fit into its elements. Moreover, the introduced solution does not seem to be reconcilable with the principle of subsidiarity of criminal law, as it constitutes an excessive interference of criminal law in corporate relations, threatening the abuse of this institution.

This article analyses the amendment to Article 296 § 4a of the Penal Code, which broadened the circle of entities that may file a request for prosecution of the criminal offence of punishable mismanagement without damage. Prior to the amendment, only the aggrieved party had such a right, but now it is also available to a partner, shareholder, or stockholder of the aggrieved company or a member of the aggrieved cooperative. The purpose of this analysis is to assess whether this amendment was actually necessary and whether its introduction aligns with the principle of subsidiarity in criminal law. In the author’s opinion, there is insufficient justification for this amendment, and its introduction appears to be the result of a faulty identification of the reasons for the rare application of the provision sanctioning the criminal offence of mismanagement without damage. The legislator has identified the limited circle of persons who may file a request for prosecution as the primary reason for its lack of practical application. However, in fact, the lack of application of this provision lies in its construction, which significantly limits the range of factual circumstances that can be qualified under its statutory elements. Furthermore, the introduced solution does not seem reconcilable with the principle of subsidiarity in criminal law, as it constitutes excessive interference of criminal law in corporate relations, increasing the risk of abuse of this institution.
The article aims to analyse mutual relations between Article 286 of the Criminal Code penalising a crime of fraud and prohibited acts under Articles 56 and 76 of the Fiscal Penal Code in order to answer a question whether the concurrence of provisions is possible and whether crimes connected with reduction of due tax liabilities by taxpayers may be classified as fraud. It is especially important in case of tax evasion connected with the use of false invoices that do not document real economic operations and where serious doubts arise as to whether there is a tax liability and, if so, whether the interests protected by fiscal penal law have been infringed. In the author’s opinion, however, the analysis of the provisions and tax regulations ON MUTUAL RELATIONS BETWEEN THE TAX FRAUD... 71 IUS NOVUM 3/2017 indicated allows stating that a crime of fraud and acts prohibited under Fiscal Penal Code differ as far as the object of protection is concerned. Thus, this is the main reason why all acts prohibited in connection with the reduction of due tax liabilities should be classified as those matching the features of fiscal crimes and misdemeanours and not the features of the crime of fraud under Article 286 CC.

Celem artykułu jest prześledzenie wzajemnych relacji pomiędzy art. 286 Kodeksu karnego penalizującym przestępstwo oszustwa a czynami zabronionymi z art. 286 k.k.
The aim of the article is to present the rules of extraneus’ liability for cooperating with the principal offender in the commission of a crime with regard to two forms of forbidden acts, namely abetting and aiding. The method of analysis of the abovementioned issue is a detailed interpretation of Article 21 § 2 of the Criminal Code (the provision that is thought to constitute liability for it). First of all, the author defines the normative content of the terms used in the provision: ‘an accomplice’ and ‘a perpetrator’ in order to decide what the scope of the meaning of the regulation is and whether it really refers to both forms of criminal cooperation. Next, the author’s considerations focus on the issue whether abetting and aiding constitute separate crimes or are only the forms of a forbidden act, and whether liability for the commission of them depends on the act committed by the principal offender. In the author’s opinion abetting and aiding are separate crimes with individual features and liability for the commission of them does not depend on the liability of other accomplices. Thus, if abetting and aiding are separate crimes, they are like common crimes in character, so anybody can commit them (with the exception of aiding by omission). Thus, the issue of extraneus’ liability for abetting and aiding can be solved without referring to the special regulation, i.e. Article 21 § 2 of the Criminal Code, which should be recognised as a statutory superfluum.

Celem niniejszego opracowania jest przedstawienie zasad odpowiedzialności ekstraneusa za przestępne współdziałanie przy przestępstwach indywidualnych w odniesieniu do dwóch form zjawiskowych czynów zabronionych, a mianowicie podżegania i pomocnictwa. Metodą analizy powyższego problemu jest dokonanie szczegółowej wykładni art. 21 § 2 k.k.
