The notion of the administrative-legal relationship is the basis of the dogmatics of Polish administrative law. Over the years, the doctrinal framework of this concept has been established by the doctrine of public law. At the same time, an extremely fruitful dogmatics discussion about this concept both in German law and practice has taken place. Therefore, the article attempts to present discoveries of the German doctrine of public law in this area. The review of the German literature conducted in the article shows that, despite some disputes, the German authors currently believe that the administrative-legal relationship is a useful tool for the analysis of rights and obligations in comprehensive legal relations, as well as cooperative frameworks. Contemporary German scholars, who do not distinguish the concept of a legal situation, unlike in Poland, believe that as part of the modernization processes in administration, the concept of the administrative-legal relationship can be used to solve complex legal issues. The above-mentioned discoveries made by German scholars could act as significant inspiration for the Polish doctrine of public law, especially in the context of the draft to introduce an administrative agreement into Polish law. Of particular importance here is the fact that in Germany there is a different system of the legal forms of administration activity, of which an administrative agreement is a vital component. It is indicated in the paper that Polish scholars see the possibility of describing complex legal constructions by the notion of the administrative-legal relationship in the simultaneous or complementary use of the concept of the administrative-legal situation. One should consider whether the same or better effects cannot be achieved much more easily, namely by modifying the understanding in the doctrine of the notion of administrative-legal relationship, more appropriate to the analysis of cooperative frameworks in administra

The primary burden of tackling the pandemic COVID-19 lies with the state as the entity responsible for protecting the health and life of its citizens. Hence, it can be argued that the focus of the pandemic-induced changes to the Polish legal order was on administrative law, which not only sets out the principles of the functioning of the State as the executive power but also governs the relations between the government, local government and citizens, which had to be significantly modified during the pandemic. It would be impossible to analyse and discuss all the emergency measures that appeared in Poland’s administrative law due to the threats posed by the pandemic. The subject matter of the present study is the analysis of the legal solutions adopted in the Republic of Poland in the sphere of public law in connection with the spread of the virus and particular provisions shaping relationships between the two basic structural branches of Polish public administration, viz. the government administration and the local-government administration. The following part of this study will accordingly be devoted to the analysis of the legislative solution contained in Article 11h of the COVID-19 Act, establishing a legal framework for issuing binding instructions to, among others, the various bodies of local governments, local-government legal persons and local-government organisational entities without legal personality.
The subject of the article is an attempt to show that concluding an urban contract is a form of public administration activity of an administrative nature, not a civil one. As a result of the contract, an administrative-legal relationship is established. Its characteristic feature is that in order for this relationship to arise it is necessary for the other party to agree. The other party is an investor who is supposed to carry out the project at his own expense. The basis for the conclusion of the contract is not the freedom of contracting, but administrative law specifying the competence of the administration to conclude a contract as well as determining the acceptable content of the contract. The urban contract is therefore an administrative contract. The article also presents the basic features of an administrative contract. In the study, the achievements of Polish and German doctrine were used. The administrative contract is not regulated under Polish law but relevant provisions are contained in the German Act on Administrative Proceedings. In addition, a public law contract has been described as an instrument of action in the implementation of European Union law. In this context, two cases were distinguished, i.e. the conclusion of a contract by national authorities and the conclusion of a contract by the Union institutions. In the latter case, it was necessary to interpret the provisions of the Treaty on the European Union and the Treaty on the Functioning of the European Union. The characteristics of the administrative contract which make it a good means of establishing an administrative-legal relationship are also presented. Of particular importance is the opportunity of creating the content of the relationship by the entities involved. This enables the formation of individual provisions adapted to a specific case. At the same time, because the consent of both parties is needed to conclude a contract, such an administrative contract protects the interests of both parties to the legal relationship. Public administration’s ability to act in specific situations must be ensured and for that reason the administrative contract will probably develop further.
Krzyżanowski was the son of Stanisław, who was a professor of history at Jagiellonian University, and Wanda, née Studnicka. His younger brother, Witold, was a professor of political economy and dean of the Law Faculty at Jagiellonian University. After his matura exams at St. Anne’s gymnasium he began to study at the Law Faculty at Jagiellonian University. After graduation he went on to complete a doctoral degree. In the meantime, he spent one term listening to lectures at the University of Vienna. Following which he started to work as a volunteer apprentice in the National Bank of Poland. He also began an apprenticeship as a barrister. After the First World War he worked at the State Treasury Solicitors’ Office, first in Cracow, then in Vilnius. His work in public administration had its influence on Krzyżanowski’s academic interests. In 1924 he published Trybunał Kompetencyjny. Studium z zakresu polskiego prawa publicznego, which qualified him for UJ’s veniam legendi in 1925. At the same time, due principally to a shortage of scientific staff, a chair of administrative law at the Stefan Batory University in Vilnius sat vacant. Krzyżanowski seemed to be the best candidate, but negotiations between the State Treasury Solicitors’ Office and the University were very long. Krzyżanowski was forced to give lectures as a substitute professor for several years, because the Ministry of Religion and Public Education didn’t permit him to be a titular professor. They treated his work at the University as being extraneous. Finally, on January 1, 1927 Krzyżanowski was reassigned to the State Treasury Solicitors’ Office in Vilnius and he also received permission to lecture at the University in Vilnius. Unfortunately, he died within a few months after a short illness. The paper contains a biography of Kazimierz Maria Krzyżanowski, along with an inventory of his scientific output.
Problematyka zbiegu egzekucji administracyjnej i sądowej nieustannie wywołuje w doktrynie i orzecznictwie szereg wątpliwości. w artykule zwracam uwagę na konsekwencje różnorodności przepisów o zarządzie w administracyjnej i sądowej egzekucji z nieruchomości.

The confluence of administrative and judicial executions creates a number of concerns arising from incompatibilities in doctrine and case law. In this paper the attention is paid to the consequences of differences in the regulations on the management of the administrative and judicial enforcement of property foreclosures. It is concluded that the regulatory differences are so significant that they often exclude the possibility of executing transfer to one of the law enforcement agencies without prejudice to the rights of the parties. In that case, when the court makes a decision its actions become a substantive, contrary to the general principles.
The digitalization of public administration constitutes a key element of modern governance in the public sector. It directly affects the efficiency of resource management and the optimization of institutional operating costs. Modern technologies have the potential to enhance the productivity of public offices by reducing procedures, improving the quality of services provided to citizens and rationalizing public expenditure. From an economic perspective, digitalization supports more transparent and results-oriented public administration management. Additionally, it enables better monitoring and analysis of data, which translates into more accurate strategic decision-making. The transition to electronic forms of communication also helps reduce bureaucracy and improve access to public services. Nevertheless, this process faces a number of barriers, such as financial constraints, a lack of human resources with appropriate competencies, digital exclusion, inconsistencies in legal frameworks, and cybersecurity risks. It is also relevant that technological changes often encounter organizational resistance stemming from attachment to traditional work models and insufficient managerial support for digital transformation. The main objective of this study is to identify the key barriers hindering the digitalization of public administration in Poland from the perspective of economic sciences. A multidimensional approach to the issue and the formulation of recommendations for public policy are essential.

The aim of the paper is to review the legal and institutional nature of the European system of supervision and the “ EU mandate” of domestic supervisory authorities. To put it differently, the paper refers to the scope of rights and obligations of financial supervision authorities derived from, indirectly and directly effective, enactments of European secondary law. A detailed analysis has been made of the legal characteristics of a regulation and directive (based on legal acts relevant to the discussed issues of the insurance market). A major focus has been placed on the importance of soft law (recommendations and guidelines), and in particular on the effect these acts have on domestic legal systems, which includes a review of the relevant case-law of the European Court of Justice. The centre of discussion is the question whether regulations adopted in the form of a recommendation directed towards domestic supervisory authorities may be used by these authorities as a legal basis for issuing guidelines for insurance companies, irrespectively of any applicable authorisation specified in domestic law and whether such regulations should pay heed to domestic legal conditions. It is argued in the paper that as non-binding sources of law become increasingly more influential within the European Union, they also affect operations of domestic authorities which are obliged to follow the guidelines of the EU bodies in their operations.

This paper presents the procedure of grievance proceedings initiated as a result of a common complaint, which is essentially simplified, informalised and of single instance. This paper also discusses the adopted methods of handling complaints and presents the issues arising in situations where the complaining party attempts to challenge the received notification on the manner of handling the complaint, expressing dissatisfaction with the response received. Manifestation of dissatisfaction with the method the complaint is handled due to single-instance nature of the grievance procedure does not refer the case to the higher instance, and is not an institution regulated in the provisions of the Code of Administrative Procedure. Challenging the method of handling a complaint results in a new complaint and the initiation of another grievance procedure before the authority that reviewed the original complaint.

: The judgment under review addressed to the problem of the effectiveness of a declaration of waiver of the right of appeal in general administrative proceedings which involve more than one party. The Supreme Administrative Court justly concluded that the above statement can only be deemed effective when it is made by all parties. It is only then that the effect materialises of the decision becoming final and legally binding. In the judgment in question, it was noted that if one of the parties to the proceedings is omitted and subsequently appeals while invoking its legal interest, the statements previously made by the party actually participating in the administrative proceedings are not effective and have no legal effect. The gloss focuses exclusively on the designated procedural institution, hence it omits consideration of the substantive law provisions applied.

The study presents the understanding of the concept of “work” and the concept of “employment” with which we deal in legislation, jurisprudence, science and didactics of labour law. The relationship between these basic categories of concepts is particularly intricate and the subject of serious controversy. The category of work is the most important and superior concept in relation to employment. Historical, axiological, technical-legislative and practical reasons speak for this. The broad understanding of work includes not only labour relations but also other relations related to it., i.e. those that make up the subject of labour law, including so-called non-employee employment relationship (civil, administrative, constitutional and penal type). In choosing between work and employment, priority should be given to work. This leads to the conclusion that the concept an employment relationship should be understood as broadly as possible. This is achieved by limiting the importance of employee subordination in definition of an employment relationship. This, in turn, leads to a tightening of scope of the concept of a non-employee employment relationship of the civil law type (from the mandate contract, contract for the provision of services).

W opracowaniu przedstawiono sposoby rozumienia pojęcia „praca” oraz pojęcia „zatrudnienie”, z jakimi mamy do czynienia w ustawodawstwie, praktyce orzeczniczej, nauce i i dydaktyce prawa pracy. Służy temu ograniczenie znaczenia pracowniczego podporządkowania w definicji tego stosunku pracy, a to z kolei oznacza zawężenie zakresu pojęcia niepracowniczych stosunków zatrudnienia typu cywilnoprawnego.
Section IVa of the act of 14 June 1960 – Code of Administrative Procedure refers to administrative financial penalties, introducing some general rules in that subject. Author considers possibility and scope of application of the rules to that fees governed by the act of 9 June 2011 – Geological and Mining Law, which are administrative sanctions, namely to increased fee and additional fee. The increased fee is applicable to activity carried out without the required concession, whereas the increased fee is charged for activity performed in flagrant violation of the conditions determined in the concession. The author came to the conclusion that an impact of the provisions of section IVa on the legal status of the fees was minimal and unsatisfactory

Dział IVa ustawy z dnia 14 czerwca 1960 r. – Kodeks postępowania administracyjnego dotyczy administracyjnych kar pieniężnych, wprowadzając generalne zasady w tym przedmiocie. Autor rozważa możliwość i zakres stosowania tych zasad odnośnie do tych opłat uregulowanych ustawą z dnia 9 czerwca 2011 r.
