Summary The non-compete clause for the duration of a party’s period of employment is a familiar feature of Polish employment contacts, and in view of its frequent occurrence has been examined from the legal aspect both by experts on the Polish Labour Code and by the judicature. This paper offers a contribution to the ongoing discussion on the need for the non-compete clause defned under Art. 101 (1) of the Polish Labour Code (umowa o zakazie konkurencji z art 101 (1) k p.) to be augmented with a statutory payment clause, in consideration both of the contractual nature of the non-compete clause as well as of the constraints it imposes on the principle of an employee’s right to work.

Ensuring the observance of human rights is a challenge faced by both international and domestic entities. This paper focuses on one of the individual’s most important social rights, i.e. the right to work. The most essential international legislation of the twentieth century is discussed in the context of the aforementioned right. It occupies a special place in the documents of the United Nations, the International Labour Organisation, as well as the Council of Europe. Moreover, the Catholic social doctrine (especially John Paul II’s teaching) emphasizes a person’s right to work, which not only ensures their and their family’s livelihood, but also facilitates their comprehensive development.

The aim of the paper is to draw attention to the discrepancies between the Polish legislation on the obligation to provide reasonable accommodation in employment compared to the standards resulting from international regulations and European labour law. This obligation remains essentially unchanged in the Polish legal system, despite the ratification of the UN Convention on the Rights of Persons with Disabilities of 13 December 2006 and the significant development of the case law of the CJEU concerning the interpretation of Article 5 of Directive 2000/78 of 27 November 2000 establishing a general framework for equal treatment in employment and occupation. It increasingly highlights the shortcomings of national regulation which significantly reduce effective protection against discrimination on grounds of disability in employment. This issue is also gaining importance in the context of the preparation by a team of experts, analysts and legislators of the draft law on equal opportunities for persons with disabilities. It increasingly highlights the shortcomings of national regulation which significantly reduce effective protection against discrimination on grounds of disability in employment. This issue is also gaining importance in the context of the preparation by a team of experts, analysts and legislators of a draft law on equal opportunities for persons with disabilities, which only to a certain extent takes into account the areas of non-compliance of the obligation to provide reasonable accommodation in employment with the mentioned standards. The analysis will also serve to present proposals for eliminating the diagnosed inconsistencies and to formulate conclusions and de lege ferenda postulates.

Omówiono szerzej dwa główne prawa społeczne zawarte w Karcie, a mianowicie: prawo do pracy i prawo do sprawiedliwego wynagrodzenia.
Introduction: The article discusses the complexity of the phenomenon of economic activity for those with disabilities and discusses the raft of economic activity factors constituting the model within this social category. Objective: Indication of the necessity to supplement this model determining the economic activity of those with disabilities due to the emergence of new barriers caused by the uncertainty of the pandemic times. Materials and methods: The analysis has employed academic and research studies (including the author’s studies) as well as statistics from the Statistics Poland (Główny Urząd Statystyczny) and the calculations of the Social Insurance Institution (Zakład Ubezpieczeń Społecznych). Secondary analysis of existing data was also employed. Results: It was pointed out that the situation of extraordinary, sudden and radical events will strengthen the existing structures and practices that will be perceived by the disabled as safer than new solutions that carry uncertainty and a risk of failure. The reforms undertaken must take into account the resistance of the existing bureaucracy and propose solutions that are less radical or that are spread out over time, in order to break the strategies of waiting and postponing changes in their position on the labor market.

Most economists are of the opinion that work, or the ability to work, is a commodity, while remuneration for work is the price of this commodity, shaped through the law of supply and demand. They point out, however, that the job market is strongly rationed. The commodity view of paid work (capability to work) is shared by rather few specialists in labour law. They opine that the job contract is effectively a purchase-sale agreement of the labour force for the sum of the remuneration. In regarding work as a commodity, they underscore the peculiar nature of the commodity, resulting from the inalienable bond between work itself and the person who performs it. The bond must be protected, mainly through appropriately liberalised labour law.Along with most specialists in labour law, the author is against the commodity view of work as being in discord with the dignity of persons, for whom work is not only the most appropriate way of securing survival but the source of the development of human nature. People engage in work with all their personalities, not only with the mere ability to perform it. Because of the right to live and the obligation to protect it, public authorities should grant everyone the right to earn their own living, and in the cases of shortage of work, they should grant material help to the worker and his or her family.

This article examines the stimuli and implications of the employment decentralization trend within the European Union, highlighting the spiral in self-employment. The demarcation between traditional dependent employment and self-employment has culminated in the evolution of distinct legal frameworks and protective measures. These frameworks traverse substantive labour laws, social security provisions, health insurance, and tax structures, each meticulously designed to cater to the specific needs and attributes of workers within these separate employment categories. Given the escalating prominence of the self-employment domain, there’s an emerging imperative for a re-defined labour legislation strategy. This strategy aims to harmoniously combine freedoms and self-employment with the EU’s foundational principles, including solidarity, equitable treatment, and robust social protection.

In Germany since generations sweatshops for persons with severe handicaps do exist. As to § 56 of the Social Code IX these institutions have to develop, improve, unfold or restore the capabilities of persons with severe handicaps. They are addressed to persons, who are-depending on the manner and severity of their handicap-cannot be employed on the general labour market. They should contribute in sweatshops to a minimum standard of economic production and their transition into the general labour market should be supported.
