Celem autora niniejszego opracowania jest poddanie pod rozwagę postulatu wyodrębnienia zasady wyborów uczciwych, jako prawnego wyznacznika wyborów demokratycznych. Przedstawione są w nim argumenty przemawiające za umiejscawianiem tej zasady w szeregu podstawowych zasad prawa wyborczego, a tym samym za uznaniem jej za jeden z fundamen-talnych prawnych „filarów”, czy też gwarancji demokratycznego procesu wyborczego, a w szerszym planie – za jedną z głównych zasad demokracji przedstawicielskiej, czy nawet całego ustroju demokratycznego państwa. W opracowaniu są też wskazane zagadnienia i wiążące się z nimi standardy wyborcze, w których kontekście powinna być rozpatrywana zasada uczciwych wyborów. Należy do nich zaliczyć: 1) niezaangażowanie państwa w proces rywalizacji wyborczej; 2) niezależność, bezstronność i przejrzystość działania tzw. administracji wyborczej i – w ogóle – „zarządzania” wyborami; 3) zapewnienie właściwych technicznych i organizacyjnych warunków głosowania, jak też prawidłowego, w pełni wiarygodnego obliczania wyników wyborów i uznawania głosów za nieważne; 4) finansowanie wyborów; 5) istnienie skutecznych procedur składania i rozpatrywania skarg na nieprawidłowości pojawiające się w procesie wyborczym, jak też rozpatrywania sporów wyborczych; 6) prawnokarna ochrona wyborów; 7) weryfikacja wyborów; 8) stworzenie warunków do obserwacji przebiegu wyborów przez niezależnych obserwatorów międzynarodowych oraz z państwa, w którym one się odbywają. Z punktu widzenia realizacji zasady uczciwych wyborów doniosłe znaczenie ma ponadto właściwy poziom poinformowania wyborców o procesie wyborczym, strukturze i mechanizmach rządzenia, jak też o kandydatach i partiach konkurujących w wyborach.

The aim of the work is to discuss the demand for identifying the principle of fair elections as a legal determinant of democratic elections. It presents arguments for including this principle among the basic principles of election law, and thus for considering it as one of the fundamen¬tal legal “pillars” or the guarantees of democratic electoral process, and in a broader perspec¬tive, as one of the key principles of representative democracy or even the whole democratic system of a state. The paper also presents the issues and related electoral standards which pro¬vide the context for analyzing the fair elections principle. These are: 1) the state not being in¬volved in the electoral competition process; 2) independence, impartiality and transparency of activity of so-called electoral administration and election “management” in general; 3) ensuring the appropriate technical and organizational conditions of voting as well as proper, fully relia¬ble way of computing the election results and regarding votes as invalid; 4) financing of the elections; 5) effective procedures of making and considering complaints about irregularities in the electoral process as well as settling disputes; 6) criminal law protection of elections; 7) veri¬fication of elections; 8) ensuring the conditions for the elections being observed by independent international and domestic observers. Another important thing from the point of view of im¬plementing the fair elections principle is keeping the voters informed at the proper level about the electoral process, the structure and mechanisms of exercising power, and about the candi¬dates or parties that stand for election.
