Celem tego opracowania jest ogólne przedstawienie niektórych ostatnich trendów, które pojawiły się w związku z nauką i nauczaniem prawa rzymskiego. Są one dostrzegalne w szerszym kontekście roli oraz funkcjonowania nauczania prawa rzymskiego na wydziałach prawa w XX wieku. Ponadto, wskazuje się w tym opracowaniu, że tendencje dotyczące badań nad rzymskimi źródłami prawa, które ujawniły się w amerykańskich szkołach prawniczych, mają potencjał umożliwiający wzbogacenie dyscypliny oraz mogą pozwolić na postawienie nowych pytań dotyczących prawa rzymskiego.

The aim of this piece is to present an overview of certain recent trends which have emerged in the study and teaching of Roman law. These trends are identified and placed within the larger context of the role and function of the teaching of Roman law in Law Schools during the twentieth century. In addition, it is argued in this piece that trends regarding the study of Roman legal sources which have emerged in the context of U.S. Law Schools have the potential to enrich the discipline and to permit new questions to be asked about Roman law.

Artykuł porusza tematykę jurysprudencji socjologicznej Roscoe Pounda ze szczególnym uwzględnieniem koncepcji inżynierii społecznej, a także wykorzystania prawa jako narzędzia, poprzez które założenia tej koncepcji są realizowane. W artykule przedstawiono również pojęcia kluczowe dla założeń inżynierii społecznej, a konkretnie teorię interesu społecznego zdefiniowaną przez R. Pounda oraz teorię etapów rozwoju społecznego, które stanowią podstawę, dzięki której realizacja założeń inżynierii społecznej jest możliwa wraz ze źródłami inspiracji jakimi kierował się R. Pound w procesie kształtowania swoich teorii. Koncepcję inżynierii społecznej zestawiono następnie z teoriami Leona Petrazyckiego, Alfa Rossa oraz Karla Poppera. Wskazane zostały także korzyści oraz zagrożenia płynące z inżynierii społecznej. We wnioskach poruszono tematykę aktualności myśli R. Pounda w kontekście współczesnej demokracji oraz potencjalnych zagrożeń dla wolności obywatelskich jakie płyną z realizacji założeń filozofii R. Pounda.

The article discusses the subject of Roscoe Pound’s sociological jurisprudence with particular emphasis on the concept of social engineering, as well as the use of law as a tool through which the assumptions of this concept are implemented. The article also presents the key concepts of social engineering, specifically the theory of social interests, defined by R. Pound, and the theory of social development stages, which theories form the basis which enables the assumptions of social engineering to be implemented. The article also presents the sources of inspiration that R. Pound was guided by in the process of developing his theories. The concept of social engineering is compared to the theories of Leon Petrażycki, Alf Ross, and Karl Popper. The benefits and threats of social engineering are also indicated. The conclusions touch upon the subject of the topicality of R. Pound’s philosophy in the context of contemporary democracy and the potential threats to civil liberties that could flow from the implementation of the assumptions of R. Pound’s philosophy.
