RPM w handlu elektronicznym – la nouvelle vague czy nihil novi? Przegląd praktyki decyzyjnej organów ochrony konkurencji

Celem artykułu jest dokonanie analizy wybranych decyzji KE i wybranych krajowych organów ochrony konkurencji dotyczących porozumień wertykalnych polegających na ustalaniu cen odsprzedaży w handlu elektronicznym. Przyczynkiem do podjęcia tej tematyki jest niedawne badanie sektorowe KE analizujące konkurencyjność handlu elektronicznego. Wnioski z tego badania wskazują, że dostawcy w znaczny sposób wpływają na politykę cenową swoich odsprzedawców, co potencjalnie – w ocenie organu – może mieć negatywny wpływ na konkurencję. W artykule w pierwszej kolejności przedstawiona jest charakterystyka handlu elektronicznego i ewentualnych, istotnych z perspektywy prawa konkurencji, różnic w stosunku do handlu tradycyjnego. Charakterystyka ta pozwala postawić hipotezę o braku podstaw do tworzenia nowych kryteriów analizy RPM w kanałach dystrybucji online. Hipotezę tę zdaje się również potwierdzać analiza praktyki decyzyjnej organów ochrony konkurencji. Jednocześnie okoliczność stosowania RPM w handlu elektronicznym powinna skłaniać organy ochrony konkurencji do uważnej analizy kontekstu ekonomicznego tej praktyki, w tym w szczególności potencjalnej motywacji dostawcy do jej wdrożenia.

The Internet offers a wide range of varied contents to its users. There are different kinds of activities in which people from all over the world can participate, as no geographical impediments are present. Children and young people use the Internet enthusiastically to take part in social life which nowadays is held mostly in cyberspace. They all dream about being popular and wellknown users. Therefore, they support their friends’ unusual behaviors. Young people create their own trends which, if they stick to them, guarantees that they are accepted community members. These behaviors are not always moral. Cyberspace is a place where parental control disappears. Social media become young people’s private space. Moreover, they take part in a new and dangerous phenomenon, called sexting. This extremely risky misbehavior may have an influence on their lives. Furthermore, sexting can increase the rate of paedophilic activities on the Internet. The main aim of the article is to describe sexting and its influence on children and young people.
