Celem opracowania jest przybliżenie wybranych rozważań sądu arbitrażowego o znaczeniu prejudycjalnym, w szczególności dotyczących jurysdykcji oraz pojmowania zarzutu pozbawienia prawa do sądu. Orzeczenie, o którym mowa w artykule, wydane zostało przez Instytut Arbitrażowy Sztokholmskiej Izby Handlowej, w postępowaniu wszczętym na podstawie art. 26 Energy Charter Treaty (dalej: ECT, Traktat, Karta).

This ruling was issued by the Arbitration Institute of the Stockholm Chamber of Commerce, in proceedings under Article. 26 Energy Charter Treaty (hereinafter the ECT, the Treaty, the Charter). The aim of this paper is to present some considerations regarding the importance of arbitration rulings, in particular concerning jurisdiction and the understanding of the deprivation of the right of the plea to the court.
