Perché il consenso sia validamente prestato, si richiede un minimo di conoscenza della natura del matrimonio, quel minimo che valga a distinguere il negozio matrimoniale da qualsiasi altro: la norma é data nel nuovo codice dal can. 1096 § 1. Esso non rappresenta sostanzialmente una novità, ma puntualizza e conferma una interpretazione dottrinale e giurisprudenziale, ormai prevalente, del vecchio can. 1082, che ha sostitutio. Nello suo studio l’autore commenta la disposizione del can. 1096 §§ 1-2 nei suoi singoli elementi.
