This case concerns marriage contracted by 43-year-old D. with 34-year-old P. (after more than four-year acquaintance), which lasted for 2 years and then broke down due to notorious avoidance of the procreation by the respondent (contraception), while the petitioner when entering this marriage intended – directly and principally – woman’s effective ability to procreate. The sentence (pro nullitate) was given in third instance on two grounds of nullity: error by the petitioner concerning a quality of a person – can. 1097 § 2 CIC (for the second time) and exclusion of bonum prolis by the respondent – can. 1101 § 2 CIC (for the first time). It contains a number of noteworthy issues – both in substantial and evidential aspect; this applies both to the first and the second ground of nullity. The sentence c. Montier is a confirmation of the jurisprudence directions in the interpretation and application of both can. 1097 §3 and can. 1101 § 2CIC – in regards to bonum prolis.

The case concerns marriage between Ad. and Adal., concluded in 1991. The woman decided to conclude marriage and wanted to conclude it according the law of Church and wanted her  usband to have qualities thanks to which married life would be a true communion of life by mutual and joint actions. Before marriage she became convinced that her fiancé had all those qualities. However, almost immediately after the marriage was concluded, the man’s behaviour radically changed and their life together got worse and worse, so finally she left her husband. Then she brought the matter before the Tribunal of First Instance (canon 1097 § of Code of Canon Law), where a positive judgment was passed. Nevertheless, the judgment was negative in the Tribunal of Second Instance. As a result, the matter was brought before the Tribunal of Third Instance where again a positive judgement was passed, namely a judgment annulling the marriage (1.01.2008). The author presents and comments the final judgment, drawing attention to all elements of legal norm.

Si tratta della sentenza negativa emanata nel tribunale di IIΙ istanza da due titoli: della incapacità                                e dell'errore circa la qualità della persona. Il Tribunale di prima istanza ha esaminato la causa da qutatro titoli decretando „pro vinculo”, mentre il tribunale d’apello ha emanato sentenza affirmativa solo da due titoli sopra indicati.

L’autore presenta e commenta la sentenza della Rota Romana c. De Angelis nella causa Reg. Apuli seu Baren. Nullitatis matrimonii del 16 giugno 2006, giudicata dai cinque titoli di invalidità, tra i quali i due sono stati introdotti dopo l’appello dalla sentenza della prima istanza. Nella sua sentenza il turno rotale ha pronunciato – come tribunale di prima istanza –l’invalidità del matrimonio solo dal titolo l’incapacitas assumendi dalla parte dell’attore.
