Il papa Benedetto XVI, nella sua allocuzione pronunciata in occasione dell’inaugurazione dell’anno giudiziario del Tribunale Apostolico della Rota Romana il 21 gennaio 2012 al Collegio dei Prelati Uditori, agli officiali, agli avvocati e agli altri collaboratori, ha sviluppato il tema riguardante l’aspetto primario del ministero giudiziale, ovvero l’interpretazione della legge canonica in ordine alla sua applicazione.Il Sommo Pontefice ha fatto ricordare che l’ermeneutica del diritto canonico è strettamente legata alla concezione stessa della legge della Chiesa. In particolare ha rilevato il valore dell’unità nell’interpretazione e nell’applicazione delle leggi che è richiesta dalla giustizia, indicando i mezzi giuridicamente vincolanti che tendono ad asicurare quell’unità. Dopo aver presentato il discorso papale, l’autore fa qualche osservazione sul tema intrapreso dal Benedetto XVI.

Separacja w prawie kanonicznym

This article presents, in a concise and clear way, a general review of issues related to the institution of separation in the system of canonical law. The author raises problems of both procedural and code law, which allows discussing every separate issue in a complete manner. Premises necessary for pronouncing separation, procedures of pronouncing separation, effects of separation and questions connected with the process of reconciliation of marriage through spouses’ return to the full married life together or the death of either of them are discussed one after another. They are all systematized and discussed using the bullets system. Furthermore, suitable subsections are introduced in the article to make it clearer and finally more accessible to the reader.

The author presents an interpretation of can. 34 § 1–3 CCL concerning instructions. The analyses show that today names of general measures issued by authorities having the executive power present a big conceptual chaos. The author has proven that the facts indicate that the intention of the legislature in the work of codification aiming to standardize the names misfired. In his opinion, the norm included in canon. 34 CCL remains only a written record because a definition of instructions codified in canon. 34 § 1 of the CCL is in practice the only point of reference which allows classifying general application acts issued by the executive power.

Autor dokonał interpretacji kan. 34 § 1–3 KPK dotyczącego instrukcji. Z przeprowadzonych w tym artykule analiz wynika, iż współcześnie w nazewnictwie aktów o charakterze generalnym, wydawanych przez autorytety posiadające władzę wykonawczą, występuje duży chaos pojęciowy. Autor dowiódł, iż taki stan faktyczny wskazuje na to, iż zamiar ustawodawcy występujący w pracach kodyfikacyjnych, zmierzający do ujednolicenia nazewnictwa, spełzł na niczym. W jego przekonaniu zapis ujęty w kan. 34 KPK pozostaje zapisem wyłącznie na papierze. Definicja instrukcji skodyfikowana w kan. 34 § 1 KPK w praktyce stanowi bowiem jedynie punkt odniesienia, pozwalający sklasyfikować wydawane przez władzę wykonawczą akty o charakterze generalnym.
