On May 6, 2013 the Tribunal of third instance in Poznan, after considering a case of marriage nullity on the grounds of incapacity to assume the essential obligations of marriage for causes of a psychic nature on the part of the man (ca. 1095 n. 3 CIC), gave an affirmative sentence, what mean that marriage recognized for invalid. The author of article presents course of process in the first two instance and comment in detail sentence of third instance concentrating especially on material and procedural issues of the marriage canon law. On the first place he raises the problem of alcoholism and its influence on the validity of the marriage consensus. The theme is a presentation of the current issues of our times and concerns extremely gentle and difficult problems because of its subject, character and range.

Alcoholic disease that is in other words alcoholism develops on the very different mental basis of human’s being. As the reasons of alcoholic dependence it is recognized for example such as: imperfect relations in family; the systematic using medication by parents; smoking; drinking the alcoholic beverages; the low level of education the present person – although this disease touches also people with tertiary education; the lack of ambition and life purposes; the lack of active social life; lack of religion practice; the exploration of powerful impressions and experiences especially among the young people, big curiosity and powerful pressure from the colleagues etc. The lawsuit’s demonstration of alcoholic dependence, as the reason to contract marriage demands from the Church judge the ability to interrogation the parties, witnesses ,collection of available documents, medical certificates and achievement the evidence from psychologist or educator expert’s judgment. The judgment the Church’s courts can not stay outside the latest spheres and checking thesis of medical and psychological knowledge. The trial of this thesis does not use all issues connected with alcoholic disease. We interest only of her influence of the statement on the invalidation an arranged marriage. It believes, that in indirect approach raising in thesis issues can equally cause the change of our thinking and attitude to people in all, whereas especially to people, who are dependence of alcoholic drinks.

L’articolo presentato dall’autore contiene in se stesso le cose seguenti: notizie iniziali; l’alcolismo e l’icapacita’ per empire dei oblighi del matromonio; motivi e sintomi dell’alcolismo; perturbazioni psichici e biologici causate della dipendenza dell’alcolismo; psicosi di passaggio dell’alcolismo; psicosi stabili dell’alcolismo; il problemma terapeutico dell’alcolismo; le cause per constatare nullita’del matrimonio per i motivi dell’alcolismo; il diritto di intentare causa matrimoniale ed la assumere o rigetare; il corso di procedimento delle prove; deposizioni delle parti; i documenti; deposizioni dei testi; l’aiuto dei periti; l’articolo si finisce con una parola di conclusione. La struttura di quell’articolo in punti e’ stata conservata cosi come e’ in CIC del 1983. Per quanto riguarda la giustificatione d’assumere del tema, allora all’inizio non sembrava di essere la questione cosi l’originale. Pure la litteratura della questione che e’ stata messa in aggiunti e’ cosi ampia che si puo’ sembrare che tutto gia’ e’ stato detto sul problema della Chiesa cattolica di fronte alle cause per constatare nullita’del matrimonio per i motivi dell’alcolismo o dal divorzio civile. Inoltre, proprio in questo tema abbiamo voluto assumere un dovere della riflessione propria sul problema della Chiesa cattolica di fronte l’alcolismo e l’icapacita’ per empire dei oblighi del matromonio ed innnazitutto in spirito di dimostrare della questione cosi dificile ed molto complicata.
