Problem konwalidacji zwykłej w wyroku c. Caberletti z 18 stycznia 2008 roku

The presented study is a commentary to the judgment of c. Caberletti of the 18 January 2008 regarding the validity of the convalidation on the Brisbanen. case. The author of the article analysed in detail the individual segments of  he rotal judgment: the course of the case and the legal and actual motives, enriching his considerations in the footnotes used in the publication. He showed that in the doctrinal part, ponens was based on the theory of a legal act and on publications of a theoretical and legal nature, by Urbano Naverrete. He indicated that the rotal judges proved the validity of the convalidation, as it proved that the defendant has the will to contract a true marriage.

Zaprezentowane opracowanie jest komentarzem do wyroku Roty Rzymskiej c. Caberletti z 18 stycznia 2008 roku dotyczącym ważności konwalidacji w sprawie Brisbanen. Autor artykułu poddał szczegółowej analizie poszczególne segmenty rotalnego orzeczenia: przebieg sprawy oraz motywy prawne i faktyczne, ubogacając swe rozważania w przypisach stosowanymi publikacjami. Wykazał, iż w części doktrynalnej ponens bazował na teorii aktu prawnego oraz na publikacjach o charakterze teoretycznoprawnym, autorstwa Urbano Naverretego. Wskazał, iź turnus rotalny udowodnił ważność konwalidacji, gdyż dowiódł, iż pozwana miała wolę zawarcia prawdziwego małżeństwa.

This article offers a discussion about the revised translation can. 1055–1165 of the Code of Canon Law of 1983. The new translation was approved by the Polish Bishops’ Conference on November 18, 2021. The author discusses the most important changes in the translation into Polish of the canons regulating marriage, giving the justification for the revision. In most cases, the changes consist of linguistic corrections, especially stylistic ones. Sometimes, however, thorough verification of the existing translation revealed the necessity of more substantial modifications. One of the reasons inspiring the new translation was the ambition to adjust the language of the Code of Canon Law to the Polish language of the law and lawyers’ language.

Artykuł zawiera omówienie zrewidowanego przekładu kan. 1055-1165 Kodeksu prawa kanonicznego z 1983 roku. Nowe tłumaczenie zostało zatwierdzone przez Konferencję Episkopatu Polski dnia 18 listopada 2021 roku. Autor omawia najważniejsze zmiany w tłumaczeniu na język polski kanonów regulujących małżeństwo, podając uzasadnienie dokonanych nowelizacji. W większości przypadków zmiany polegają na dokonaniu korekty językowej, zwłaszcza stylistycznej. Niekiedy jednak skrupulatna weryfikacja dotychczasowego przekładu ujawniła konieczność dokonania poważniejszych merytorycznych modyfikacji. Jedną z racji inspirujących nowy przekład było pragnienie dostosowania języka Kodeksu prawa kanonicznego do polskiego języka prawnego i prawniczego.
