Cel. Celem artykułu jest refleksja teoretyczna na temat podejmowania przez kobiety decyzji o ciąży i macierzyństwie po 35 roku życia. Omówione koncepcje. Artykuł oparty jest na dotychczasowych badaniach na temat macierzyństwa. Dla wielu współczesnych kobiet macierzyństwo nie stanowi życiowego priorytetu. W związku z tym odkładają decyzję o ciąży na późniejsze lata bądź całkowicie odrzucają myśl o dziecku. Głównym założeniem artykułu jest analiza przyczyn tego globalnego zjawiska. Wyniki i wnioski. Uznaje się, że przemiany ustrojowe i polityczne lat 90. ubiegłego wieku przyczyniły się do powszechności późnego macierzyństwa w Polsce. Najczęstsze powody podejmowania decyzji o ciąży dopiero po 35 roku życia to: wydłużona edukacja w Polsce, znacząca pozycja kariery zawodowej w życiu wielu młodych ludzi, brak stabilizacji finansowej, nastolatyzacja dorosłości oraz lęk przed łączeniem obowiązków zawodowych i rodzinnych. Wartość poznawcza. W artykule zaprezentowano kompleksowe zestawienie psychospołecznych uwarunkowań późnego macierzyństwa. Może to stanowić obszar dalszych badań i rozważań.

Aim. The aim of the present article is to provide a theoretical reflection on women making decisions about pregnancy and motherhood after the age of 35. Concepts discussed. The article was written on the basis of studies concerning motherhood. The number of women, for whom motherhood is not important, is constantly increasing – they postpone a decision on maternity, or they are unwilling to have offspring. The main goal of the article is to present the reasons for this common phenomenon. Results and conclusions. It is believed that the state structure and political system of the 1990s have contributed to late maternity in Poland. Common causes for pregnancy and delivery among women aged 35 and over are prolonged education in Poland, the importance of a professional career for many young people, lack of financial stability, a childish adulthood and a fear of combining professional and private (family) responsibilities. Cognitive value. The article is a comprehensive theoretical summary of the psychosocial conditions of late motherhood. It can be an area for further research and consideration.

II Concilio Vaticano II ha portato una concezione nuova del matrimonio, mettendo l’accento sulla relazione interpersonale e sull’amore, chiamando il matrimonio con la formula intima communita vitae et amoris coniugalis e portando sicuramente una piu equilibrata valutazione degli elementi dei matromio che sono l’amore ed il suo aspetto procreativo. Esclusione dell’amore chiamato dal Codice dell’83 esclusione dei „bonum coniugum” definito dalla dottrina e dalla giurisprudenza come „communitas vitae” oppure la relazione interpersona le che si crea tra i coniugi è l’esempio della simulazione parziale di tratta questo articolo. Come causa simulandi viene presentata l’immaturità affettiva che tradizionalmente viene interpretata dagli autori come causa dell’incapacità descritta dal canone 1095 CIC. Visto, però, che presentata anomalia distrugge soprattutto ogni possibilità di creare una relazione interpersonale tra i nubenti crediamo che essa possa essere interpretata come causa simulandi dell’esclusione del „bonum coniugum” fatta implicite.

Taking up the issue of emotional immaturity as a cause for declaring a marriage null and void, the author begins his reflections with a look at human personality. The cause of the nullity of a marriage discussed here, in turn, requires a rather precise definition of the notion of emotional immaturity and of the factors by which it may be triggered. The last part of the author’s reflections is devoted to the analysis of canon 1095 of the Code of Canon Law, especially to the definition of cases when this immaturity is serious enough to exclude marriage validity.
