Il papa Benedetto XVI, nella sua allocuzione pronunciata in occasione dell’inaugurazione dell’anno giudiziario del Tribunale Apostolico della Rota Romana il 21 gennaio 2012 al Collegio dei Prelati Uditori, agli officiali, agli avvocati e agli altri collaboratori, ha sviluppato il tema riguardante l’aspetto primario del ministero giudiziale, ovvero l’interpretazione della legge canonica in ordine alla sua applicazione.Il Sommo Pontefice ha fatto ricordare che l’ermeneutica del diritto canonico è strettamente legata alla concezione stessa della legge della Chiesa. In particolare ha rilevato il valore dell’unità nell’interpretazione e nell’applicazione delle leggi che è richiesta dalla giustizia, indicando i mezzi giuridicamente vincolanti che tendono ad asicurare quell’unità. Dopo aver presentato il discorso papale, l’autore fa qualche osservazione sul tema intrapreso dal Benedetto XVI.

By implementing the fundamental goal of the article, which is to highlight the impact of John Paul II on the development of canonic studies, the Author starts by pointing out the theological focus fundamental for the contemporary canonist, outlined with reference to coinciding anniversaries (John Paul II’s visit at the Catholic University of Lublin, the promulgation of 1917 Code of Canon Law, Fatima Apparitions and St Therese of Lisieux’s offering herself to Merciful Love).The extraordinary meaning of the Polish Pope for the renewal of Canon Law is shown by pointing out his legislative activeness and his contribution to the methodological and epistemological development of canonic studies. The author expresses his conviction that the picture thus created should be completed with conclusions drawn from the analysis of the connection between the mystic experience of John Paul II with his legislative activity.

Realizując podstawowy cel artykułu, jakim jest uwypuklenie wkładu Jana Pawła II w rozwój nauki kanonistycznej, Autor wychodzi od zwrócenia uwagi na podstawowe dla współczesnego kanonisty ukierunkowanie teologiczne, nakreślone z odwołaniem się do zbiegających się rocznic (wizyty Jana Pawła II w Katolickim Uniwersytecie Lubelskim, promulgacji Kodeksu Prawa Kanonicznego z 1917 r., Objawień Fatimskich oraz ofiarowania się Miłości Miłosiernej przez św. Teresę z Lisieux). Wyjątkowe znaczenie Papieża-Polaka dla odnowy prawa kanonicznego ukazane jest przez zwrócenie uwagi na jego aktywność legislacyjną oraz wkład w rozwój metodologiczny i epistemologiczny nauki kanonistycznej. Autor wyraża przy tym przekonanie, że stworzony w ten sposób obraz powinien zostać uzupełniony o wnioski wyprowadzone z analizy związku doświadczenia mistycznego Jana Pawła II z jego aktywnością legislacyjną.

The article is divided into three parts. In the first one works on the formulation of the norm on jurisdiction supply by the Church during the first codification have been reviewed. The author quotes archival documents and preparatory schemata in which one can notice the evolution of what is to become the canon 209. The scope of application of the rule supplet Ecclesia as well as the conditions in which doubt or common error may occur have been specified in the light of authentic interpretations and the canonical heritage of the first half of the 20th century. In the second part the process of creation of the current canon 144 and its interpretation has been outlined. Discussion of these issues during preparation of the new codification and subsequent drafts are quoted after the periodical Communicationes.  The meaning of particular elements of the traditional rule’s new formulation is presented in the perspective of former and current commentaries. The third part is dedicated to the application of the supplet Ecclesia principle in the specific situations of the Church’s life. The first paragraph of the canon can be applied among the others in case of invalid acquisition of an ecclesiastical office for undisclosed reasons as well as the death of the ordinary if it remains unknown to the public. The reader will also find discussions about the implementation of the rule in question in connection with canon 883, the circumstances in which the Church supplies the faculty to celebrate the sacrament of penance or the scope of application of the canon 144 in the assistance at marriages.  The present elaborate shows that the outline of the history of the interpretation of the supplet Ecclesia principle in the last 100 years helps to better understand and apply the canon 144 of the current Code.
