Colagiovanni causam examinavit et senteniam negativam edixit. Récurrente actore ad tumum sequentem (c. Burke), die 18 iulii 1997 sententia rotalis tumi praecedentis confirmata est. Illam sententiam rotalem c. Burke, in qua clare distinctio inter incompatibilitatem characterum et incapacitatem assumendi essentiales matrimonii obligationes explicitur (diversitas indolis viri et mulieris non aufert capacitatem tradendi et accipiendi iura et officia coniugalia), auctor présentât et commentât.

Vaginismus, understood as a disease / disorder can become a cause of incapacity within the meaning of can. 1095 n. 3 KPK. „Este Decreto confirmatorio de una sentencia de Primera Instancia confirma una sentencia de nulidad matrimonial por incapacidad para asumir las obligaciones esenciales del matrimonio. La causa que lleva a esta decisión es la ludopatía del esposo que ejercía un importante cargo como funcionario. Son pocas las sentencias que existen sobre el juego patológico. En este Decreto el ponente estudia los diversos aspectos de esta anormalidad de la persona que le provoca una exagerada adicción al juego. La característica esencial de la adicción grave al juego consiste fundamentalmente en la supeditación de todos los aspectos de la vida de la persona a la consecución de un fin que es el juego compulsivo. Este hecho resulta ser gravemente perturbador del consorcio matrimonial que en ocasiones es también instrumentalizado en aras de la obtención de bienes económicos para emplear en el juego. Este Decreto confirmatorio puede resultar muy interesante para conocer la relación que existe entre dicha ludopatía y la validez del matrimonio en cuanto aquella influye decisivamente en la capacidad para afrontar las obligaciones que implica el modo de vida en común del matrimonio”
