The peculiarity of military criminal proceedings consisted in their approach and regulation concerning formal defense. This approach had been equally peculiar, since in the inter-war period, it was possible to notice a certain level of distrust towards defense lawyers from outside the military circles, and preference for military personnel or lawyers who used to serve in the military. Such approach was also based upon substantive reasons, since criminal cases presented in courts-martial involved not only a degree of professionalism required of all lawyers, but also an understanding of the military structure and relationships. The defense lawyer’s ability to understand those matters benefitted not only the defendant, but also the military judicial service. This, in turn, had constituted the foundation for the emergence of a small group of lawyers and officers of the judicial service—separate from the defense lawyers appearing before the common courts—who would participate in military court proceedings. This function was performed by some of the most eminent defense lawyers of the inter-war period. For the military judiciary, the function of the military defense lawyer constituted a convenient form of practice for the future military judges and prosecutors, which manifested itself in the practice of assigning assistants and legal interns the role of court-appointed attorneys.

The research issues which Marta Paszek is interested in are an extremely important aspect in the history of the system and law of the People's Republic of Poland. The historiography to date relating to the military judiciary at that time is definitely dominated by publications discussing trials that bore all the rules of lawful procedure. The viewpoint of these works is (quite rightly so) to present the martyrdom of the defendants, to quote draconian sentences and the fate of the convicted. Marta Paszek's monograph of course takes these issues into account, but the author has significantly expanded the scope of her research, which should be considered the right direction. The review article is an attempt to discuss the structure of the monograph, to evaluate the sources used, to analyse the value and appropriateness of the content of individual chapters, as well as changes to the doctoral dissertation defended in May 2018. It also assesses the legitimacy of undertaking the subject of analysis of the activities of the Military District Court in Katowice and the need to publish the same monograph in terms of the needs of historical and legal sciences and the proper exhaustion of the subject by the author. The evaluations of other entities, such as other reviewers, the Council of the Faculty of Law and Administration of the University of Silesia in Katowice and the Institute of Justice were also noted.

Problematyka badawcza, którą zainteresowała się Marta Paszek to niezwykle ważny aspekt w historii ustroju i prawa Polski Ludowej. W dotychczasowej historiografii odnoszącej się do ówczesnego sądownictwa wojskowego zdecydowanie dominują publikacje omawiające procesy urągające wszelkim zasadom praworządnej procedury. Optyką tych prac (zupełnie słuszną) jest przedstawianie martyrologii podsądnych, przytaczanie drakońskich wyroków, losów osób skazanych. W monografii Marty Paszek uwzględnione zostały oczywiście te kwestie, ale Autorka znacznie rozszerzyła zakres swoich badań, co należy uznać za właściwy kierunek. Artykuł recenzyjny stanowi próbę omówienia struktury monografii, oceny wykorzystanych źródeł, analizy wartości i adekwatności treści poszczególnych rozdziałów, a także zmian w stosunku do bronionej w maju 2018 r. rozprawy doktorskiej. Ocenie poddano również zasadność podjęcia tematyki analizy działalności Wojskowego Sądu Rejonowego w Katowicach oraz potrzebę publikacji tejże monografii pod kątem potrzeb nauk historyczno prawnych oraz należytego wyczerpania tematu przez Autorkę. Zauważono również oceny innych podmiotów, takich jak pozostali recenzenci, Radę Wydziału Prawa i Administracji Uniwersytetu Śląskiego w Katowicach czy Instytut Wymiaru Sprawiedliwości.
