This paper discusses the legal issues of penal reaction towards sex offenders diagnosed with paraphilia. Conviction of sex offenders may include long imprisonment terms as well as compulsory treatment within a forensic facility – according to art. 95a of the Criminal Code. There is doubt as to whether such severe sanctions under criminal law, which may cause serious adverse health consequences for the offender (a side effect of hormonal medication) is consistent with the basic principles of law. In this case, the most important issue is the compatibility of this approach with the principle of proportionality in sentencing coercive measures – art. 93 of the Criminal Code and the prohibition in light of art. 40 of the Polish Constitution on the use of corporal punishment. The authors also assess the public point of view, influenced by the mass media, regarding sex offenses.

The considerations made in this article justify the conclusion that a paraphilic assesses the marriage from a selfish perspective, because everything he does is aimed at satisfying his pleasure. He does not consider the other person or the possibility of treating him objectively - in other words, a parafilik treats his partner as a thing to satisfy his selfish need for pleasure. Meanwhile, in the marriage relationship, closeness and realization of the good of the other party are sought as an equal partner. On the other hand, paraphilism, which is a sexual impulse, destroys not only the marriage but the spouse and, to a greater or lesser extent, the paraphilic himself. In a marriage with a paraphilic, there is no stability, no realization of the spouse's good, no realization of the community of life and love, only instinctive satisfaction, which is also unnatural. Nevertheless, regardless of the definition of paraphilia in medical sciences and psychology, when conducting a trial in an ecclesiastical court, it should be verified in the light of the concept of Christian anthropology, proper to canon studies. The paraphilia itself does not nullity it, it all depends on the severity of the disorder in question and its impact on the functioning in marriage.

In spite of a long-lasting criticism by several international human rights bodies, the Czech Republic is the last EU member state which still perform therapeutic surgical castration of sex offenders and men suffering from certain paraphilias. While critics consider the practice medically unnecessary and inhuman, proponents claim that therapeutic surgical castration offers the last hope to patients in whom other treatment options failed. This paper analyses the question of whether and under what circumstances can surgical castration be considered permissible. After that, the legal regulation in the Czech Republic and the relevant international criticism are dealt with. The identified criteria of permissibility are then applied to the Czech regulation and practice of castration.

The conducted analyzes show that the representatives of the doctrine of canon law perceive paraphilias as a threat to marriage and family, considering them as an example of psychosexual disintegration of a given person. According to the canonists, the discussed deviations may prevent the conclusion of a valid marriage covenant due to the paraphiliac’s incapacity to undertake and fulfil important marital duties such as: establishing a conjugal marital community of life, to establish an interpersonal relationship between spouses, to maintain a permanent, faithful, mutual and long-lasting relationship, to maintain heterosexual community, to give birth and raise offspring or to have intimate life realised humano modo. However, the mere presence of paraphilia does not prejudge the fact that a person is incapable of entering into marriage. In this regard, the canonists recommend taking into account the degree of intensity of a given anomaly, thus referring to the studies of Urbano Navarrete and Italian psychiatrist Gianfrancesco Zuanazzi. At the same time, it is necessary to avoid rash judgement as to the severity of the paraphilia in question, and to carefully evaluate each case submitted, taking into account the type of deviation, its features and also the personality of the contracting party.

Z przeprowadzonych analiz wynika, że przedstawiciele doktryny prawa kanonicznego traktują parafilie jako zagrożenie dla małżeństwa i rodziny, traktując je jako przykład dezintegracji psychoseksualnej danej osoby. Zdaniem kanonistów omawiane odstępstwa mogą uniemożliwić zawarcie ważnego przymierza małżeńskiego ze względu na niezdolność parafilika do podjęcia i wypełnienia istotnych obowiązków małżeńskich, takich jak: ustanowienie małżeńskiej wspólnoty życia, ustanowienie więzi międzyosobowej między małżonkami, utrzymanie stałego, wiernego, wzajemnego i długotrwałego związku w celu utrzymania wspólnoty heteroseksualnej, urodzenia i wychowania potomstwa lub urzeczywistnienia współżycia intymnego humano modo. Jednak sama obecność parafilii nie przesądza o niezdolności osoby do zawarcia małżeństwa. W tym zakresie kanoniści zalecają uwzględnienie stopnia nasilenia danej anomalii, odwołując się tym samym do badań Urbano Navarrete i włoskiego psychiatry Gianfrancesco Zuanazziego. Jednocześnie należy unikać pochopnej oceny wagi danej parafilii i uważnie oceniać każdą przedstawioną sprawę, biorąc pod uwagę rodzaj odchylenia, jego cechy, a także osobowość kontrahenta.

In the presented study, the author reflects on the nature of acrotomophilia in the context of conducting a trial in a church court. The analyzes show that in the case of acrotomophilia, we are dealing with a serious sexual disorder. The conducted analyzes show that acrotomophilia may have a destructive influence on marital life, leading to its breakdown. Hence, this study shows that in church courts, marriage nullity cases could be conducted out of consensual incapacity (can. 1095, n. 2-3 CCI) and deception (can. 1098 CCI).

The article focuses on issues of motives of sexual offenders i.e. rapists. The source of atypicality of motives described by the author is a stereotype of sexual reasons for crimes under art. 197 of the Polish Criminal Code, which are not confirmed in psychiatric studies. The cognition of rapists’ motives has a positive influence not only on crime detection but also on the proceedings at the stage of judgment passing and carrying out the penalty (resocialization).

Artykuł poświęcony jest problematyce motywacji sprawców przestępstwa przeciwko wolności seksualnej – zgwałcenia. Źródłem atypowości opisywanych przez autorkę motywów jest stereotyp o seksualnych przyczynach przestępstw z art. 197 k.k., najczęściej nieznajdujący pokrycia w badaniach psychiatrycznych. Poznanie motywacji sprawców nie tylko wpływa pozytywnie na wykrywalność przestępstw, lecz także na przebieg prowadzonego postępowania, zarówno w procesie wyrokowania, jak i na etapie wykonania kary – resocjalizacji.
