Nella struttura del can. 1098 del CJC del 1983, con il quale l'errore provocato dall’inganno circa qualche qualità dell’altra parte che per sua natura può turbare gravemente il consorzio della vita coniugale ha ottenuto rilevanza per invalidare il matrimonio, il componente molto importante è l’oggetto dell’inganno cioè qualche qualità capace - per sua natura - a turbare gravemente il consorzio della vita coniugale. L'analisi di quel frammento dei canone ci permette di constatare che si tratta di una qualità posta direttamente in relazione con il consorium vitae coniugalis toccando l’essenza, le proprietà essenziali e i fini del matrimonio, quindi valutata oggettivamente. Secondo la piu recente tendenza della giurisprudenza rotale non si può nemmeno prescindere da una valutazione di carattere soggettivo circa la perturbazione del consorzio della vita coniugale.

Il canone 1098 CIC stabilisce, per la prima volta nella disciplina canonica, la rilevanza invalidante del dolo sui consenso matrimoniale. Nel presente lavoro ci chiediamo quale sia la natura della rilevanza invalidante del can. 1098: di diritto naturale о positivo? La maggioranza degli Autori è d’accordo che la norma del detto canone è di diritto positivo. Ci sono, peró, anche quegli Autori che sostengono che detta norma proviene dal diritto naturale. Presentando le diverse opinioni in questione cerchiamo di presentare anch e la nostra posizione in favore della positiva provenienza della norma del can. 1098 CIC.

The subject of this study is the jurisprudence of the Roman Rota Court regarding deceptive misleading (canon 1098 CIC) from 2010-2012, contained in Decisione seu sententiae. During this period, the title of marriage annulment was included in twelve judgments; ten of them have been published. The analysis of rotating sentences was presented in the following thematic areas: deceptive misleading as a factor protecting marriage consent; deceptive action; error as a result of deception; the attribute of a person as an object of deceptive action (in genere and in individual judgments); deceptio dolosa prove. Undoubtedly, the jurisprudence of the Roman Rota also provides for the area of deceptive misleading, the appropriate point of reference in the resolution of nullitatis matrimonii cases by church tribunals of lower degrees of jurisdiction.

The title of nullity of marriage in the form of deceptive deception (can. 1098) is an expression of the Church legislator’s concern for the protection of a marriage choice (getting to know the future spouse), as well as for the protection of the marriage itself against injustice. One of the constitutive elements of the canon – apart from deception and error – is the attribute of the other party (qualitas personae), which can gravely disturb the partnership of conjugal life. The author analyzes the seventeen judgments of the Roman Rota from 2000-2005 issued for deceptio dolosa in the aspect of the quality of the other party. In the first part, he draws attention to the rules of interpretation of rotational jurisprudence concerning the quality of the person in genere, i.e. the very concept of qualitas, the nature of the attribute and the assessment of its significance for the community of conjugal life. On the other hand, in the second part, he discusses the attribute of a person in specie, and thus points to specific qualities that were the subject of evaluation by the judges of the Roman Rota in these seventeen cases (health, child paternity, addiction to superstition, religiosity, abortion, simulated pregnancy).

Tytuł nieważności małżeństwa w postaci podstępnego wprowadzenia w błąd (can. 1098)  stanowi wyraz troski ustawodawcy kościelnego o ochronę wyboru małżeńskiego (poznanie przyszłego małżonka), a także o ochronę samego małżeństwa przed niesprawiedliwością. Jednym z elementów konstytutywnych kanonu – poza podstępem i błędem – jest przymiot drugiej strony (qualitas personae), który może poważnie zakłócić wspólnotę życia małżeńskiego. Autor analizuje 17 wyroków Roty Rzymskiej z lat 2000-2005 wydanych z tytułu deceptio dolosa w aspekcie przymiotu drugiej strony. W części pierwszej zwraca uwagę na zasady interpretacyjne orzecznictwa rotalnego dotyczące przymiotu osoby in genere, a więc samego pojęcia qualitas, charakteru przymiotu i oceny jego znaczenia dla wspólnoty życia małżeńskiego. Natomiast w części drugiej omawia  przymiot osoby in specie, a więc wskazuje na konkretne przymioty, które były przedmiotem oceny sędziów Roty Rzymskiej w owych siedemnastu sprawach (stan zdrowia, ojcostwo dziecka, uzależnienie od zabobonów, religijność, dokonanie aborcji, symulowana ciąża).
