The issues related to private evidence and documents in Polish criminal proceedings have for a long time been providing an impetus for many debates and disputes. In his text, the author analyses the opinions hitherto expressed in legal doctrine, and based on them he indicated how, in his opinion, the notions of “private evidence” and “private document” ought to be understood in accordance with the Code of Criminal Procedure. To this aim, he commences his consideration with an analysis of the notion of “evidence”, while stressing that it needs to be distinguished from such terms as “[a piece of] information” or “trace”. Further on, he discusses the distinction into “public [official]” and “private” evidence, and also presents his own definition of “private evidence” sensu stricto and sensu largo. Subsequently, the author proceeds to consider the notion of document in legal system, in particular in penal legal system, to eventually focus on the intended understanding of the notion of “private document” and the notion “reading aloud” included in Article 393 paragraph 3 of the Code of Criminal Procedure.

Nach Maßgabe des can. 1527 §1 können Beweise jeder Art erbracht werden, die zur Beurteilung einer Sache förderlich erscheinen und zulässig sind. Es stellt sich die Frage, ob private Dokumente (Aufzeichnungen, Tagebücher, Korrespondenz), die ohne Wissen des Autors und Besitzers erworben wurden, im Ehenichtigkeitsprozess als Beweisangebot angenommen werden können. Es ergibt sich eine Spannung zwischen der Pflicht des Wirkens pro rei veritate und dem Prinzip, dass durch das Ziel die Mittel nicht geheilt werden. Es ist gleichzeitig die Spannung zwischen dem Recht auf ein gerechtes (der objektiven Wahrheit entsprechendes) Urteil und dem Schutz der Intimsphäre. Der Richter darf sich nicht soverhalten , als ob diese Beweismittel nicht existierten. Es muss darauf dringen, dass die betroffene Person sich mit der Vorlage dieser Beweise ein verstanden gibt. Deren event. Absage unterliegt ethischen Abwägungen.

Celem niniejszego artykułu jest analiza przydatności i ukazanie sposobu wykorzystania metody biograficznej w badaniach zjawisk zachodzących w gwarze staroobrzędowców mieszkających w Polsce na podstawie materiałów zebranych podczas ekspedycji dialektologicznych w latach 2014–2017. Udostępnione badaczom prywatne dokumenty i nagrania rodzinne stanowią ważny materiał językowy i socjolingwistyczny. W przekazanym materiale biograficznym odnaleźć można nie tylko osobiste refleksje staro obrzędowców, ale również informacje na temat życia codziennego całej społeczności i/lub poszczególnych osób oraz relacje z określonych zdarzeń. Wspomnienia i relacje osób badanych są niezwykle ważne dla badaczy rosyjskiej gwary staroobrzędowców, ponieważ poszerzają korpus tekstów i nagrań o nowe sfery tematyczne (swobodne wypowiedzi na tematy osobiste, domowe i rodzinne), stylistyczne (artystyczna funkcja gwary w utworach poetyckich), a także stanowią przykłady spontanicznych wypowiedzi (uroczystości wspólnotowe i rodzinne).

This article discusses the usefulness of the biographical method and describes the way it is employed in studying the dialect of the Old Believers living in Poland. Private family documents and recordings, which were made available to the researchers and collected during dialectological expeditions in the years 2014-2017, constitute a significant language and sociolinguistic material. In the biographical material, we can find not only personal reflections of the Old Believers, but also information about everyday life of the whole community and/or of specific people, as well as reports from particular events. Memories and reports of the respondents are especially important for the researchers of the Russian dialect of the Old Believers because they enrich the corpus of texts and recordings with new thematic (casual utterances concerning personal life, household, family) and stylistic areas (artistic function of the dialect in poetic works), as well as with examples of spontaneous utterances (community and family celebrations).
