The author analyses the structure of the policy aimed at preventing domestic violence in Poland from the perspective of the historical development of public policies of domestic violence prevention in Poland and the sources of and causes for particular solutions. Especially close attention is paid to the aetiology of roadeningthe protection guaranteed by human rights, which both in the world and Europe was extended from public space onto the private sphere of individual persons. Moreover, what is discussed is the process of buildingsocial (civil) framework of the most important institutions related to the prevention of domestic violence in Poland. The author presents the manner of establishing and implementing elements creating the systemof violence prevention at the state level. He utilises classical methods of analysis, known in the field of public policies study.

Autor analizuje strukturę polityki walki z przemocą w rodzinie w Polsce, z perspektywy historycznego rozwoju polityk publicznych przeciwdziałania przemocy domowej w Polsce oraz źródeł i przyczyn stojących za konkretnymi rozwiązaniami. Szczególną uwagę poświęca etiologii kształtowania się procesu rozszerzania ochrony praw człowieka z przestrzeni publicznej do sfery prywatnej konkretnych jednostek na świecie i w Europie, a także budowaniu społecznych (obywatelskich) i instytucjonalnych ram najważniejszych instytucji związanych z przeciwdziałaniem przemocy w rodzinie w Polsce. Przedstawia sposób formułowania orazimplementowania na gruncie krajowym elementów tworzących system przeciwdziałania przemocy. Posługuje się klasycznymi metodami analizy znanymi z zakresu wiedzy o politykach publicznych.

In recent years the problem of domestic violence in Poland is particularly frequent. It is extremely difficult to solve because it requires cooperation between entities co-executing the program counteracting this phenomenon as well as both the victim and their perpetrator. From the viewpoint of ongoing activities, continuing dissemination and updating in the local environment every information about institutions and organizations providing help to people entangled in the problem of violence is crucial, just as constant verification of the effectiveness and quality of the tasks undertaken.

W ostatnich latach w Polsce szczególnie częsty jest problem przemocy domowej. Jest on o tyle trudny do rozwiązania, że wymaga współpracy zarówno ofiary, jak i sprawcy przemocy z podmiotami współrealizującymi program przeciwdziałania temu zjawisku. Istotne jest z punktu widzenia prowadzonych działań, ustawiczne rozpowszechnianie i aktualizowanie w środowisku lokalnym informacji o instytucjach i organizacjach udzielających pomocy osobom uwikłanym w problem przemocy oraz stała weryfikacja skuteczności i jakości podejmowanych zadań.

The presented problem concerns the socially important issue of domestic violence. The aim of the article is to draw attention to the existing problem in the commune and the ways of counteracting violence. A great importance is given to the research covering the residents of the commune. The research results show that the problem exists. The victims of violence are mainly women and children, and the authors of the violence are their closest relatives. Much attention is paid to the help provided by the commune, family, institution, interdisciplinary team or the implementation of the Blue Cards procedure. The results of the research emphasize the importance of the commune's measures. Even more coordinated actions of the services should be undertaken to increase the safety of the victims and, above all, to increase the availability of various forms of assistance.

Przedstawiony problem dotyczy społecznie ważnego zagadnienia przemocy w rodzinie. Celem artykułu jest zwrócenie uwagi na istniejący problem w gminie oraz na sposoby przeciwdziałania przemocy. Dużo miejsca poświęcono badaniom, którymi objęto mieszkańców. Wyniki badań wskazują, że problem istnieje. Ofiarami przemocy są głównie kobiety i dzieci, a ich oprawcami osoby najbliższe. Dużo uwagi poświęcono pomocy ze strony gminy, rodziny, instytucji, zespołu interdyscyplinarnego czy realizacji procedury Niebieskie Karty. Wyniki badań podkreślają ważność działań gminy, należy podjąć jeszcze bardziej skoordynowane działania służb aby zwiększyć bezpieczeństwo ofiar ale przede wszystkim zwiększyć dostępność różnorodnych form pomocy.

Prezentowany artykuł zawiera rozważania dotyczące diagnozowania lokalnego systemu przeciwdziałania przemocy w rodzinie na przykładzie gminy Skawina. W części teoretycznej omówiono kwestie definicyjne związane ze zjawiskiem przemocy oraz przedstawiono charakterystykę systemu przeciwdziałania przemocy w rodzinie w Polsce. W drugiej części zaprezentowano założenia metodologiczne procesu diagnozowania problemu przemocy w gminie Skawina, omówiono wybrane wyniki badań oraz wnioski z analiz empirycznych.

This article considers diagnosing a local system for combating domestic violence as exemplified by Gmina Skawina, Poland. In the theoretical part, the article discusses definitional issues related to domestic violence and presents the characteristics of the Polish system for combating domestic violence. The second part presents the methodological assumptions of the process of diagnosing domestic violence in Gmina Skawina, and discusses selected research results and conclusions from empirical analyses.

The main aim of the article is to analyze the issues of ecology in religious communication in the context of the manifestations of cancel culture in relation to the Roman Catholic Church. The basic subject of these considerations is the encyclical Laudato si’ by Pope Francis, as well as the literature on cancel culture, with particular emphasis on the intuition of Jo-Rene Formicola. In connection with the analysis of religious communication about ecology, research was used that shows to what extent the social encyclical of Pope Francis, called green or ecological, was an important topic of discussion in the pages of the most popular Catholic opinion weeklies in Poland. Analyzing the issues of religious communication about ecology on the basis of Laudato si’, directions for the development of the “ecology of human everyday life” were proposed, taking into account the reference to counteracting violence against people and animals. The article was funded under the programme of the Minister of Education and Science "Regional Initiative of Excellence" in 2019--2023, project no. 28/RID/2018/19, amount of funding: PLN 11,742,500.

Głównym celem artykułu jest analiza problematyki ekologii w komunikowaniu religijnym w kontekście przejawów cancel culture w odniesieniu do Kościoła rzymskokatolickiego. Podstawowym przedmiotem niniejszych rozważań uczyniono encyklikę Laudato si’ papieża Franciszka, a także literaturę poświęconą cancel culture, ze szczególnym uwzględnieniem intuicji Jo-Rene Formicoli. W związku z analizą komunikowania religijnego o ekologii sięgnięto do badań, które ukazują, w jakim stopniu encyklika społeczna papieża Franciszka, zwana zieloną lub ekologiczną, stanowiła istotny temat dyskusji na łamach najpopularniejszych katolickich tygodników opinii w Polsce. Analizując problematykę komunikowania religijnego o ekologii na podstawie Laudato si’, zaproponowano kierunki rozwoju „ekologii ludzkiej życia codziennego”, uwzględniające odniesienie do przeciwdziałania przemocy wobec ludzi i zwierząt. Artykuł finansowany w ramach programu Ministra Edukacji i Nauki pod nazwą „Regionalna Inicjatywa Doskonałości” w latach 2019-2023 (nr projektu 28/RID/2018/19, kwota finansowania 11 742 500 zł).

The article shows the problem of the rights of older people being violated, from a criminological, victimological, and normative perspective. The work includes international and national regulations of various branches of law. Above all, however, the focus is on criminal law regulations. Criminological research in Poland and worldwide related to the victimisation of older people was compared with the provisions of criminal law. Such a project was carried out to answer the question of whether current criminal law is an appropriate and adequate response to physical, psychological, sexual, and economic violence against the elderly, or whether it neglects and abandons them. The diagnosis of Polish legislative solutions determined by the authors does not lead to an optimistic thesis that the rights of these people are fully protected by criminal law. The particular vulnerability of older people to victimisation has not been sufficiently addressed by the legislature.

Publikacja ukazuje problem naruszania praw osób starszych z perspektywy kryminologicznej, wiktymologicznej i normatywnej. W pracy uwzględniono międzynarodowe i krajowe regulacje różnych gałęzi prawa. Przede wszystkim jednak skoncentrowano się na regulacjach prawnokarnych. Wyniki światowych i polskich badań kryminologicznych związanych z wiktymizacją osób starszych skonfrontowane zostały z przepisami prawa karnego. Zabieg taki miał dać odpowiedź na pytanie, czy prawo karne stanowi właściwą i adekwatną reakcję na przemoc fizyczną, psychiczną, seksualną i ekonomiczną wobec osób w podeszłym wieku oraz zaniedbywanie ich i porzucanie. Postawiona przez autorki diagnoza polskich rozwiązań legislacyjnych nie pozwala na sformułowanie optymistycznej tezy, że prawa tych osób są w pełni chronione przepisami prawa karnego. Szczególna podatność osób starszych na wiktymizację nie została bowiem wystarczająco uwzględniona przez ustawodawcę.

Providing the need for security fundamentally affects the ability of the individual to pursue life prospects and thus the quality and standard of living for modern families. The scale and complexity domestic violence indicates that the fight against it requires a determined and multi-faceted activity by the public authorities. Assuming this, such a goal is served by the newly introduced amendment to the law on preventing domestic violence. The present amendment introduces a range of solutions relevant and useful, however, analysis of individual provisions of the amendment raises a doubt whether the Polish law in its current shape, actually protects the family or - paradoxically - is a source of threat to it. The new law on preventing violence in the family has blurred the traditional, culturally and historically conditioned concept of the family, altering its accepted definition. In the name of counteracting domestic violence, it protects many ways of common coexistence, including same-sex relationships, while undermining the bonds of kinship of the extended family. Domestic violence is a social reality that requires strong state intervention, but this condition should not be combated by means which can be the ground for the development of further types of pathology. An amendment to legal provisions, even if it contributes to the fight against domestic violence, may not recognize the family as a whole and will not offer protection to all aspects of family life. The legislative shortcoming in question, and the subsequent dangers caused by such regulation cannot be regarded as a factor to safeguard the well-being of the contemporary Polish family and thus improve the quality of life for its members.

Die Gewährleistung der Sicherheit betrifft die Fähigkeit eines Individuums, um die Perspektiven im Leben zu entwickeln und die Qualität des Lebens der modernen Familien zu verbessern. Das Ausmaß der Gewalt zeigt, dass der Kampf gegen sie eine starke und facettenreiche Tätigkeit der Behörden erfordert. Eine Änderung des Gesetzes über die Gawaltprävention soll in diese Richtung führen. Die aktuelle Änderung hat eine Reihe von wichtigen und nützlichen Lösungen, sondern die Analyse der spezifischen Bestimmungen der Novelle wirft Zweifel, ob das polnische Recht in seiner jetzigen Form tatsächlich die Familie schützt oder - paradoxerweise - ist eine Quelle der Gefahr für sie. Das neue Gesetz über die Gewaltprävention verwischt das traditionelle, kulturelle und historischbedingte Konzept der Familie. Im Namen der Bekämpfung häuslicher Gewalt präsentiert eine Reihe von Möglichkeiten der gemeinsamen Koexistenz, einschließlich gleichgeschlechtliche Beziehungen, und schwächt die Bande der Verwandtschaft in der Familie. Die häusliche Gewalt ist eine gesellschaftliche Realität, die eine starke staatliche Intervention erfordert. Sie soll aber nicht durch die Gesetze, die die Grundlagen für die Entwicklung neuer Arten der Pathologie sind, überwunden werden. Die Änderung des Gesetzes, auch wenn es um den Kampf gegen die häusliche Gewalt geht, kann die Familie als das Ganze nicht erkennen und keinen Schutz in allen Aspekten des Familienlebens bieten. Die Gesetzeslücken und das anschließende Risiko einer solchen Regelung kann nicht als ein Faktor für das Wohlbefinden der zeitgenössischen polnischen Familie angesehen werden.

The aim of this paper is to analyse and evaluate the system of protection and prevention of family violence, as well as to compare the legal assumptions with the practice of their application. The paper points out various possibilities of preventing violence, both direct and indirect, as well as the difficulties of taking actions, which are caused by the complexity of the phenomenon of family violence. The review of police statistics shows how the scale of this phenomenon is changing against the background of the changing system.

Celem pracy jest analiza i ocena systemu służącego ochronie praw ofiar przemocy w rodzinie oraz przeciwdziałaniu przemocy, a także skonfrontowanie założeń prawnych z praktyką ich stosowania. Wskazane zostały różne możliwości, jakie są wykorzystywane w celu przeciwdziałania przemocy, zarówno bezpośrednie, jak i pośrednie. A także trudności, jakie widoczne są w podjętych działaniach, które źródło swe mają w złożoności zjawiska, jakim jest przemoc w rodzinie. Przegląd statystyk policyjnych ukazuje, jak zmienia się skala tego zjawiska na tle zmieniającego się systemu.
