This article addresses the issue of bringing about a road disaster. The author’s goal is to verify the following hypothesis: “… in the case-law of the courts of appeal, criteria have been developed to allow a person to commit an offense or crime specified in art. 173 § 2, § 4 of the Penal Code (Official Gazette of 1997, No. 88, item 553, as amended) supported by five questions: 1. What are the causes of an event that disrupts traffic in a sudden and dangerous manner? 2. What are the characteristics of a road disaster? 3. What are the characteristics of other traffic events among which collision and accident can be distinguished? 4. On what types of roads can a disaster happen? 5. Has thesis 12, contained in the resolution of the Supreme Court of February 28, 1975, reference number V KZP 2/74, lost its validity in modern times?” The exploration of these unclear issues was undertaken by an analysis of the acts and resolutions of the Supreme Court, and the rulings of the courts of appeal.

W artykule podjęta została problematyka dotycząca sprowadzenia katastrofy w ruchu drogowym. Autor za cel obiera weryfikację następującej hipotezy: „…w orzecznictwie sądów apelacyjnych wypracowane zostały kryteria pozwalające na stwierdzenie dopuszczenia się przez daną osobę występku lub przestępstwa określonego w art. 173 § 2, § 4 Kodeksu karnego (Dz. U. 1997 Nr 88 poz. 553 z późn. zm.) wspartej pięcioma pytaniami: 1. Jakie przyczyny mogą powodować powstanie wydarzenia zakłócającego w sposób nagły i groźny ruch lądowy?; 2. Czym cechuje się katastrofa w ruchu drogowym?; 3. Jakie cechy posiadają inne zdarzenia w ruchu drogowym wśród których wyróżnić można kolizję oraz wypadek?; 4. Na jakich typach drogi może zdarzyć się katastrofa?; 5. Czy teza 12 zawarta w uchwale SN z dnia z dnia 28 lutego 1975 roku o sygnaturze akt V KZP 2/74 utraciła swoją aktualność w czasach współczesnych?” Odpowiedź na niejasne kwestie została wsparta między innymi analizą: ustaw, uchwał Sądu Najwyższego, czy też orzecznictwa sądów apelacyjnych.
