The aim of this article is to discuss Agamben’s distinction between dzoē and bios and verify if the category of bare life would be relevant to the life of animals. At first glance, following Agamben’s line of thought, one might say that the very helplessness of the modern law in the face of dzoē results in ephemeral and certainly not inalienable animal rights. Thus, what Agamben calls homo sacer would also refer to animals as animal sacrum. However, when extended to include animals, Agamben’s philosophical project shows serious constraints which are cleverly camouflaged under the linguistic argument and his rather selective interpretation of Aristotle’s works.

Sacrum obejmuje tak różnorodne kategorie i wartości, że nie sposób przypisać mu jednego, wspólnego pojęcia – łączy je jedynie nazwa. W teoriach antropologiczno-kulturowych oraz fenomenologicznych sacrum przybiera wielorakie formy, co czyni tę kategorię bardziej pojemną znaczeniowo. Sacrum przenika nie tylko sferę religijną, ale także kształtuje ludzkie doświadczenie, nadając mu głębszy wymiar. Może być również rozumiane nominalistycznie, jako czysto nazwowa konstrukcja. Niemniej jednak w swojej uniwersalnej denotacji odnosi się do sensów religijnych, transcendentnych, wykraczających poza codzienność i dążących ku wyższym wartościom.

The sacred encompasses such diverse categories and values that it is impossible to assign it a single, unified concept – only the name remains common. In anthropological-cultural and phenomenological theories, the sacred takes on multiple forms, making this category more conceptually expansive. The sacred not only permeates the religious sphere but also shapes human experience, giving it a deeper dimension. It can also be understood nominalistically, as a purely linguistic construct. Nevertheless, in its universal denotation, it refers to religious and transcendent meanings that go beyond everyday existence and aspire to higher values.
