This article deals with the issue of spontaneous possession in the context of the seizure of a share in co-ownership of real estate. The purpose of the work is to answer the question of whether the seizure of a share in co-ownership is possible in the current state of the law, and what role the premise of spontaneous possession plays in this process. In particular, the paper addresses the problem of the admissibility of the seizure of shares in co-ownership of real estate, the issues of the seizure of a share in co-ownership of real estate under German law, analyzes the institutions of spontaneous possession as a prerequisite for seizure, and whether a co-owner can be a spontaneous possessor, as well as the institutions of legal presumption under Article 339 of civil code and the institutions of quoad usum in the context of the seizure of shares. The study of the issue was carried out on the basis of the dogmatic method, in addition, the scientific literature on the subject and the case law of the Supreme Court were used. The result of the conducted research is a partial negative answer to the question posed in the research hypothesis.

Artykuł ma na celu przedstawienie zagadnień konstytucyjnoprawnych związanych z pierwszym po wyborach posiedzeniem Senatu RP. Autor dokonał merytorycznej analizy kwestii podmiotu zobowiązanego do zwołania pierwszego posiedzenia, formy prawnej tego zwołania, terminu i miejsca posiedzenia a także przedmiotu, czyli porządku posiedzenia. Dokonano podziału na obligatoryjne i fakultatywne punkty porządku posiedzenia. W artykule znalazło się także kilka wniosków dotyczących statusu Marszałka senior. Autor skupia uwagę przede wszystkim na analizie konstytucyjnych regulacji dotyczących poruszanej problematyki przy uwzględnieniu przepisów regulaminu izby.

The purpose of this article is to present the constitutional and legal issues related to the first sitting of the Senate of the Republic of Poland after the elections. The author made a substantive analysis of the issue of the entity obliged to convene the first sitting, the legal form of this convocation, the date and place of the sitting, as well as the subject matter, i.e. the agenda of the sitting. A division was made into obligatory and optional points of the agenda of the meeting. The article also contains several conclusions concerning the status of the Senior Speaker. The author focuses his attention primarily on an analysis of the constitutional regulations concerning the issues raised, obviously taking into account the provisions of the rules of the chamber.

W artykule poruszono problematykę siedzącego trybu życia dzieci i młodzieży w Polsce. Przedstawiono krajowe i światowe dane statystyczne wskazujące na niewystarczający poziom aktywności fizycznej polskich uczniów oraz informację na temat chorób i stanów chorobowych towarzyszących siedzącemu trybu życia. Przedstawiono związek między aktywnością fizyczną i uczeniem się. Zaprezentowano możliwość wykorzystania w procesie nauczania aktywnych krzeseł zaprojektowanych tak, aby wymuszać ruch i spontaniczną zmianę pozycji (tzw. wiercenie się).

The article discusses the problem of the sedentary lifestyle of children and youth in Poland. National and world statistics showing the insufficient level of physical activity of Polish students and information on diseases and disease states accompanying a sedentary lifestyle were presented. The relationship between physical activity and learning and the possibility of using active chairs in the teaching process designed to cause movement and drilling was presented.

Michał Łazarski (1896–1944) was born in Sztabin in Suwałki Governorate. His parents were Teofila and Józef. He was a deputy of Sejm of the Republic of Poland in the years 1928-1938 and subsequently a senator from 1938 until 1939. He was also a well-known local government activist in the Białystok Voivodeship. He was interested in agriculture and the military. Before he started his career in the Parliament, he had fought for his Motherland as a member of The Polish Military Organisation as well as during the Polish-Soviet War. Michał Łazarski died at the time of the Warsaw Uprising on 1st of August 1944. The main point of this publication is to present his parliamentary activity. The biography of Łazarski was a subject of research by H. Majecki, J. Rółkowski, G. Ryżewski, W. Batura, A. Makowski, J. Szlaszyński and others. The majority of information about the deputy was gathered in a publication called “Aktywni w codzienności: z dziejów instytucji i stowarzyszeń gminy Sztabin”. The main resources of Łazarski’s parliamentary activity of the interwar period are Sejm and Senate documents located in the Sejm Library’s website (https://biblioteka.sejm.gov.pl). I have also used press materials and publications describing the history of Polish parliamentarism. The point of this publication is also to present how the Sejm and Senate in II Republic of Poland operated. The parliamentary activity of Michał Łazarski in the interwar period is a good way to realise this intention. It was a very interesting period in the history of Poland.

Michał Łazarski (1896-1944) urodził się w Sztabinie w guberni suwalskiej. Jego rodzicami byli Teofila i Józef. Michał Łazarski (1896-1944) był posłem na sejm Rzeczypospolitej Polskiej w latach 1928-1938, a następnie senatorem od 1938 r. do 1939 r. Był również znanym w województwie białostockim działaczem samorządowym. Interesowało go głównie rolnictwo oraz wojskowość. Zanim rozpoczął karierę w parlamencie, walczył w obronie Ojczyzny, będąc członkiem Polskiej Organizacji Wojskowej oraz walcząc w wojnie polsko-bolszewickiej. Zginął w trakcie powstania warszawskiego 1 sierpnia 1944 r. Podstawowym założeniem publikacji jest przedstawienie działalności parlamentarnej Michała Łazarskiego. Życiorysem parlamentarzysty zajmowali się m.in.: H. Majecki, J. Rółkowski, G. Ryżewski, W. Batura, A. Makowski oraz J. Szlaszyński. Najwięcej informacji na temat wojennych losów Michała Łazarskiego zebrano w dziele „Aktywni w codzienności: z dziejów instytucji i stowarzyszeń gminy Sztabin”. Podstawowym źródłem, zawierającym informację o działalności Michała Łazarskiego w parlamencie okresu dwudziestolecia międzywojennego, są druki sejmowe i senackie, znajdujące się na stronie internetowej Biblioteki Sejmowej (https://biblioteka.sejm.gov.pl). Korzystałem również z materiałów prasowych oraz publikacji, charakteryzujących dzieje parlamentaryzmu polskiego. Celem artykułu jest również przedstawienie, jak funkcjonował Sejm i Senatw II Rzeczypospolitej. Działalność parlamentarna Michała Łazarskiego w dwudziestoleciu międzywojennym jest dobrym sposobem do realizacji tego zamierzenia. Był to bardzo ciekawy okres w historii Polski.
