Les appels du Pape Jean Paul II (du 28 janvier 2002) adressés à des juges et avocats qu’ils évitent la participation en affaires en vue de divorce ont été le motif de cette élaboration . Son point initial est la présentation de l’indissolubité comme le droit écrit dans la nature de mariage et de personne . Ensuite ont été signalé certains symptômes favorisant la durabilité du mariage en législation polonaise c’est à dire dans le cas de séparation et de divorce. En cette dernière question on souligne le besoin d’effectuer une solide session de réconciliation. L'analyse du discours du Pape à des juges et avocats étant partie importante de l’élaboration vise à l’élimination de la mentalité de divorce.ans l’article ont été formulé des postulats et des propositions concrètes  et les attitudes attendues favorisant l’indissolubité du mariage en contexte de prescriptions polonaises par rapport à des missions et droits de juges et avocats.

The Synod of Bishops in 2014 showed how polarized are the positions in understanding and meaning of the sacramental marriage. In 2015 Holy Father Pope Francis issued new standards for testing the validity of marriages (mainly sacramental). Relevance and effectiveness of new solutions should be examined. The article focuses on the legal as well as legal and pastoral aspects of sacramentality of marriage. The standards were analysed related to the sacramentality at the stage of marriage and a declaration of non-existence or cessation of marriage. Considerations were divided into the following issues of concern: 1. Sacramentality of marriage in the teaching of the Church in the twentieth century. 2. Sacramentality of marriage in the CIC from 1983. (Esp. Can. 1055 § 1-2, 1056, 1065§ 2, 1099 1134) 3. Conclusion and cessation of non-sacramental marriages, 4. Conclusion and cessation of sacramental marriage. General conclusions and proposals for the future were described at the end. These analyses show that the sacramental nature of marriage of baptized stems from the New Testament. Dissolution of non-sacramental marriages is easier than sacramental. It is suggested that the dogmatists analyzed whether the unconditional call of a marriage contract and the sacrament is necessary. The new standards of Pope Francis require a process of their lawful use, reliability of employees in the ecclesiastical tribunals, as well as the great responsibility of the bishops and all the faithful. There is increasingly important need for a uniform discipline of the Church on marriage, including research and declared nullity. There should be increasing concern not only for people living in subsequent relationships, but also organizing special pastoral care of marriages, not just as families.

The article presents two kinds of arguments for entering into marriage: natural and supernatural. On the side of nature the most important argument is transmission of life, some kind of mutual life support of the spouses and social order. On the supernatural side the arguments can basically be addressed only to believers. They have the character of God’s promises and spiritual incentive connected with the growth of love as God’s gift, the development of sexuality and the joy of having children, permanence, loyalty and trust in the marriage relationship, learning to forgive and the flourishing of matrimonial freedom. The content of the arguments has remained unchanged for centuries, perhaps new forms of communication need to be found following the principles of the new evangelization.

W niniejszym artykule zostały przedstawione dwa rodzaje argumentów za zawarciem związku małżeńskiego: naturalne i nadprzyrodzone. W porządku naturalnym najważniejsze jest: przekazywanie życia; pewnego rodzaju wzajemne życiowe wsparcie małżonków oraz porządek społeczny. Argumenty dotyczące sfery nadprzyrodzonej mogą być kierowane zasadniczo tylko do ludzi wierzących. Mają one charakter obietnic Bożych i zachęty duchowej związanej z rozwojem miłości jako daru Bożego, dojrzewaniem seksualności oraz radością posiadania dzieci, trwałością, wiernością i zaufaniem w związku małżeńskim, nauką przebaczania i rozkwitem wolności małżeńskiej. Treść argumentów pozostaje od wieków taka sama, być może trzeba szukać nowych form przekazu, zgodnie zasadami nowej ewangelizacji.
