The article undertakes an analysis of several sentences issued by the Tribunal of the Roman Rota. The main issue is infidelity of one of the spouses. Although infidelity is not a cause of nullity of marriage, it can be taken into account as a relevant circumstance for evaluating the evidence. The analysis contains judgments for the exclusion of marital fidelity and incapacity to assume essential marital duties due to mental reasons and the exclusion of the indissolubility of marriage. The research material allows for a better understanding of infidelity itself but also highlights the proper way to proceed with cases where infidelity is the main line of evidence.

Artykuł podejmuje analizę kilku sentencji wydanych przez Trybunał Roty Rzymskiej, w których na pierwszy plan wysuwa się zdrada jednego z małżonków. Zdrada nie jest przyczyną nieważności małżeństwa, ale może być brana pod uwagę jako istotna okoliczność oceny materiału dowodowego. Przedmiotem analizy były wyroki z tytułu wykluczenia wierności małżeńskiej, niezdolności do podjęcia istotnych obowiązków małżeńskich z przyczyn natury psychicznej, a także z tytułu wykluczenia nierozerwal- ności małżeństwa. Zaprezentowany materiał badawczy pozwala na lepsze zrozumienie zdrady i właściwego sposobu procedowania spraw, gdzie linia dowodzenia koncentruje się na niewierności.

According to the canon law there are different causes of inability to contract a marriage. However in practice it is difficult to distinguish one specific cause of a psychic nature. In the Monier’s sentence, immaturity is linked to the addiction to alcohol and gambling. According to the judges, the man was afflicted with a serious disorganisation of the personality. In consequence, this premise became the basis for the ascertainment of marriage invalidity. It should be emphasised that emotional immaturity in this case was not the primary and exclusive problem of the person. Therefore, the reasoning of the Rotal Court in Monier’s judgement shows that the whole life history of the person in question should be taken into account while deciding about consensual disability.

The article addresses the issue of partial appeals in the proceedings for declaration of nullity of a marriage. It analyses various decrees issued by judges of the Tribunal of the Roman Rota. Particularly, it provides a wide spectrum of the cases whereas a party or parties have filed a partial appeal. Frequently, such appeals tend to be treated as a potential instrument for dilatory (mere dilatoria). For this reason, in such cases it is possible to deliver the judgment on the other grounds of nullity of a marriage, according to the principle of procedural economy.

Artykuł podejmuje problematykę apelacji częściowej w procesie o stwierdzenie nieważności małżeństwa. Analiza różnych dekretów wydanych przez sędziów Trybunału Roty Rzymskiej pozwala zrozumieć, jak sprawy takie traktowane są w tym apostolskim organie sprawiedliwości. Przedstawione dekrety dają szerokie spektrum dotyczące podejścia różnych turnusów do spraw, w których strona lub strony złożyły apelację częściową. Bardzo często apelacje takie są traktowane pod względem ich ewentualnej działalności na zwłokę (mere dilatria). Generalnie w takich przypadkach trzeba pamiętać o możliwości wykonalności wyroku z innych tytułów nieważności małżeństwa, co związane jest z pewną ekonomią procesową.
