The development of human civilisation led to a broad normalisation of human life. The legal system, however, must always uphold our inherent and inalienable human dignity, which means that law must be in service of the individual. The aim of the all pervading legal regulation is, generally, to ensure a harmonious socio-economic development and to facilitate the individual’s self-realisation. A function of law is, on the one hand, to fit the letter of the law to the reality and, on the other hand, to fit the reality to the letter of statutory law. A particular phenomenon which is subjected to juridification is technological progress by which human civilisation can be defined. It can lead to disruptions in functioning of the existing social, economic, political and other arrangements. Law deals with it in two aspects. Firstly, it regularises the arter-effects of the progress, including the threats it generates. Secondly, it deals with the progress itself as such.

The author has outlined the essence of legal presumptions on discretion in law enforcement of financial legal provisions as both current legal phenomena and legal regulations. The relationship between presumptions and principles of law, as well as the classification of presumptions has been researched into. Presumptions on discretion in law enforcement of financial legal provisions are formed in relation to a particular legal fact or group of facts or compositions that correspond with a particular law enforcement situation, which is due to the origin, content and purpose of these facts or compositions, the relationship between them. With regard to discretion in law enforcement of financial legal provisions, it could also be argued that there are both legally defined irrefutable presumptions (innocence, “all doubts in favour of the taxpayer”) and rebuttable in a particular case, which does not terminate its effect as a whole. It has been concluded that presumptions on discretion in law enforcement of financial legal provisions are applied due to logical methods of induction or modelling, when the probability of a phenomenon is not high enough.

This analysis aims to present the leading ideas of his social philosophy in the area of the function of the state, democracy, freedom, spontaneous order of individualism and equality.

W artykule podjęto próbę dowiedzenia, że powszechnie w zasadzie przyjmowany w państwach demokratycznych mechanizm odpowiedzialności konstytucyjnej, jest w dużej mierze oparty na micie ustrojowym, który ma przede wszystkim podłoże historyczne, ale nie odpowiada on współcześnie wyróżnianym doktrynalnym funkcjom prawa, konstytucji oraz jej gwarancji. W tym kontekście ten szczególny rodzaj odpowiedzialności prawnej wysokich urzędników państwowych został poddany głównie teoretycznej analizie funkcjonalnej oraz z uwzględnieniem kryteriów celowościowych, a także czynników, które wpływają na jego zakładany i rzeczywisty kształt ustrojowy.

The article attempts to prove that the mechanism of constitutional liability, generally accepted in democratic countries, is largely based on a systemic myth, which is primarily of historical origin, but which does not correspond to the modern doctrinally distinguished functions of law, constitution and its guarantees. In this context, this particular type of legal liability of high state officials has been subjected mainly to a theoretical functional analysis and taking into account teleological criteria, as well as factors that affect its assumed and actual systemic shape.

The premise underlying the conducted considerations is the assertion that the concept of a family household as provided for in the Act on shaping the agricultural system is dysfunctional. Firstly, the theoretical aspects of defining concepts and their functions are presented, followed by an analysis of the concept of a family holding made against the background of its formulation in the regulations in other countries. It is then concluded that the defective definition of this concept hinders the protective function of the family holding which is to secure the family character of farms, their profitability and efficiency. The analysis of the stabilising and dynamising functions of the definition of a family holding also gives rise to the claim that this definition fails to possess the characteristics that would be conducive to the strengthening of such farms and increasing their economic efficiency. A defective definition of a family holding prevents satisfactory protection of the values specified in the Constitution, and consequently obstructs the achievement of the objectives of the Act on shaping the agricultural system in Poland.

Przesłanką leżącą u podstaw prowadzonych rozważań jest twierdzenie, że pojęcie gospodarstwa rodzinnego przewidziane w ustawie o kształtowaniu ustroju rolnego jest dysfunkcjonalne. W pierwszej kolejności przedstawiono teoretyczne aspekty definiowania pojęć i ich funkcji, a następnie dokonano analizy pojęcia gospodarstwa rodzinnego na tle jego ujęcia w regulacjach innych państw. Następnie stwierdzono, że wadliwe zdefiniowanie tego pojęcia utrudnia realizację funkcji ochronnej gospodarstwa rodzinnego, jaką jest zabezpieczenie rodzinnego charakteru gospodarstw rolnych, ich dochodowości i efektywności. Analiza stabilizujących i dynamizujących funkcji definicji gospodarstwa rodzinnego daje również podstawę do twierdzenia, że definicja ta nie posiada cech, które sprzyjałyby wzmocnieniu takich gospodarstw i zwiększeniu ich efektywności ekonomicznej. Wadliwa definicja gospodarstwa rodzinnego uniemożliwia zadowalającą ochronę wartości określonych w Konstytucji, a w konsekwencji utrudnia realizację celów ustawy o kształtowaniu ustroju rolnego w Polsce.
