Artykuł dotyczy ochrony tymczasowej, która udzielana jest przed zawarciem docelowej umowy ubezpieczenia. Ochrona ta wynika z faktu zawarcia tymczasowej umowy ubezpieczenia, która kreuje odrębny stosunek prawny; jego byt prawny jest, co do zasady, niezależny od stosunku prawnego wynikającego z umowy docelowej. Nawet gdy do zawarcia umowy docelowej nie dojdzie, powinny zostać spełnione świadczenia stron tymczasowej umowy ubezpieczenia (w tym świadczenie pieniężne ubezpieczyciela w razie zajścia wypadku ubezpieczeniowego oraz świadczenie ubezpieczającego polegające na zapłaceniu składki).

The article is devoted to temporary coverage which is granted prior to the conclusion of the permanent contract of insurance. This protection results from the fact of the conclusion of the temporary insurance agreement, which establishes a separate legal relationship, in principle, independent of the legal relationship arising from the final agreement. Even if a permanent contract is not concluded, the obligations of the parties of the temporary agreement ought to be fulfilled (including the claims payment by the insurer in the event of an insurance accident and the premium payment by the policyholder).
