Leon Chajn is one of the key figures who had impact on creating the post-war judica- ture. Bearing first the function of Deputy Head in the Department of Justice and then Undersecretary of State in the Ministry of Justice, he decided on the course of the most significant changes in the functioning of the judiciary and in the assignment of positions in ministries and courts. In the article, the authors examine in depth the viewpoints of Chajn based on his publications, journals and speeches before the congresses of the Al- liance of Democrats.

The paper describes the genesis and the circumstances of the agreements concluded by the Polish Committee of National Liberation with the Soviet Socialist Republics of Ukraine and Belarus on September 9, 1944 and the Soviet Socialist Republic of Lithuania on September 22, 1944, regulating the relocation of the population and the impact their conclusion had on the signatory parties and the relocated population.

Disciplinary proceedings are these of repressive nature wherein penalties which limit the freedom and rights of a guilty person can be adjudicated. Such pro-ceedings are diversified and have no pattern for developing models of the disci-plinary responsibility of particular professions, including professions of public confidence. By focusing on the diversification of disciplinary proceedings, in-cluding the rules of such proceedings in particular models, the authoress opts for uniforming rules of the proceedings. She considers it necessary and possible to define basic rules of disciplinary proceedings which can be referred to while developing a code of disciplinary proceedings or different models of proceed-ings for particular occupation groups or professions. The article postulates rules which, according to the authoress, seem to be fundamental while not necessarily fit for all types of disciplinary proceedings. She notes that her suggestions are to be a proposal for the further discussion on developing standards of reliable pro-cedures in disciplinary proceedings.

The principle of open proceedings is a guarantee of reliable judicial process. The considerations aim at answering the question whether this principle of open proceedings is applicable to discipli-nary trials. Starting by a short characteristic of the specificity of disciplinary proceedings, the authoress passes to justifying a need of the applicability of the principle of open proceedings into all the models of disciplinary liability in order to ensure the procedural fairness and constitutional identity for the accused.

On the basis of the Polish law and court rulings, the author tries to establish in an individual aspect a normative content of individual freedom of conscience and religion (its scope). In her discussion she refers primarily to the rulings of the Constitutional Court and the European Court of Human Rights, which complement the normatively defined sphere of liberty in question.

The main topic discussed in the article is the question of the dignity of the post of judge of the common courts of law. The authoress, on the basis of the law and the jurisdiction of the disciplinary court, in that regard, sought to determine the scope of the concept of “dignity of the post of judge”. She tried to answer the question, what specific requirements should meet the judge, and how he should behave, or how he should not behave, to make his duties in dignified way? The answer was constructed by identifying the normative responsibilities, basing on the Constitution of Poland, content of the oath of judges, articles 82. and 82., points “a” and “b” of the act of the Law of the Common Court and “The Rules of Professional Ethics of Judges”. Then, under the jurisdiction of the disciplinary court of the Supreme Court was compiled the list of behaviors which affront to the dignity the post of judge.

Przedmiotem artykułu jest kwestia swoistego rodzaju odpowiedzialności represyjnej, jaką jest odpowiedzialność dyscyplinarna. Jest to istotne zagadnienie, albowiem dotyczy osoby sędziego, który nie wykonuje już funkcji orzeczniczej. W szczególny zatem sposób odczytane być winny dwa podstawowe powody zainicjowania postępowania dyscyplinarnego. Autorka rozważa przesłanki wszczęcia takiego postępowania, jego bieg, jak też konsekwencje poszczególnych możliwych orzeczeń. W szczególności podkreślone zostały skutki orzeczenia przez sąd dyscyplinarny najsurowszej z kar dyscyplinarnych, jaką jest kara pozbawienia sędziego prawa do stanu spoczynku wraz z prawem do uposażenia.

The objective of this article is a question of a particular kind of repressive liability as disciplinary liability. It is a significant issue as it concerns the judge who does not perform jurisprudence any more. In a particular way then there should interpreted two basic reasons of disciplinary proceedings initiating. The author considers circumstances of such proceedings, their course and consequences of particular possible judgements. There were emphasised consequences of the judgement of the most severe disciplinary punishments issued by the disciplinary court as the punishment of deprivation the judge of the right to retirement together with the right to be granted the pension.

Der Artikel ist eine Antwort auf die Frage nach der Bestrafungshaftung, die disziplinarische Haftung ist. Dies ist ein wichtiges Thema, da es eienen Richter betrifft, der seine richterlichen Aufgaben nicht ausführt. Es gibt zwei Hauptgründe für die Disziplinarmaßnahmen. Der Autor betrachtet die Voraussetzungen für die Eröffnung eines solchen Verfahrens, den Verlauf, sowie die möglichen Konsequenzen einzelner Entscheidungen. Er betont insbesondere die Aufmerksamkeit auf die Auswirkungen der schwersten Disziplinarmaßnahme, die die Strafe der Aberkennung des Rechts zum Ruhestand und des Rechtes zur Vergütung ist.

W sądowym procesie stosowania prawa istotne znaczenie odgrywa rola decydenta – sędziego. Decyzje sędziego, choć ujęte w ramy proceduralne i implikowane przede wszystkim przez przesłanki normatywne, nie są jedynie prostym sylogizmem prawniczym, a procesem wieloetapowym, w tym również psychologicznym. Choć sędziowie starają się o zachowanie wysokich standardów, o wyeliminowanie w orzekaniu czynników pozaprawnych, o pozostanie niezawisłymi i bezstronnymi, to całkowite wyeliminowanie czynników psychologicznych zdaje się być niemożliwe. W artykule autorki zwracają uwagę na psychologiczne determinanty orzeczeń i sygnalizują potrzebę empirycznych badań nad wpływem owych czynników na proces decyzyjny sędziego.

In the legal court process, the role of the key decision maker – the judge – is vital. The decisions of a judge, although they are enclosed in the procedures and guided, above all, by normative premises, do not constitute a simple legal syllogism, but a multi-stage process, which is also a psychological process. Although judges put great effort into maintaining high standards, to eliminate non-legal factors during the process of decision-making and to remain independent and impartial, it seems impossible to fully eliminate psychological factors. In this article, the authors analyse the psychological determinants of verdicts and indicate the need for empirical research into the influence of these factors on the decision-making process of a judge.

Eine wesentliche Rolle bei der Anwendung des Rechts in einem Gerichtsverfahren spielt der Entscheidungsträger – der Richter. Die richterlichen Entscheidungen, wenngleich diese in einen Verfahrensrahmen einbezogen sind und vorwiegend durch normative Prämissen impliziert werden, sind nicht nur als ein einfacher Rechtssyllogismus zu sehen, sondern vielmehr auch als ein mehrstufiger Prozess mit psychologischem Hintergrund. Obwohl die Richter danach streben, hohe Standards aufrechtzuerhalten, bei Urteilsfindungen die außerrechtlichen Faktoren außer Acht zu lassen, unabhängig und unbefangen zu sein, scheint eine totale Abtrennung der Faktoren psychologischer Natur unmöglich zu sein. Die Verfasserinnen weisen in ihrem Beitrag auf die psychologischen Entscheidungsfaktoren der Entscheidungen hin und legen den Bedarf nahe, den Einfluss dieser Faktoren auf den richterlichen Entscheidungsprozess empirisch zu untersuchen.
